AN ORDINANCE AMENDING THE CITY OF
MCHENRY ZONING ORDINANCE
BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF McHENRY,
ILLINOIS as follows:
SECTION 1: That the Zoning Ordinance of the City of McHenry, Illinois
as passed, approved, and as subsequently amended and now in effect and the
Zoning Map of the City of McHenry, Illinois adopted as a part of said Zoning
Ordinance be and the same are hereby amended granting a variation of the
20 foot rear yard requirement to permit the construction of a building within
5 feet of the rear yard line for the following described property, to -wit:
Part of the Southwest Quarter of Section 26, Township 45 North,
Range 8 East of the Third Principal Meridian, described as follows:
Beginning at the most Northerly Corner of Lot 9 of E. M. Owen's
Estates Addition to West McHenry, according to the Plat thereof
recorded January 31, 1893 as Document No. 9232 in Book 1 of Plats,
page 39; also being a point on the Southeasterly line of Lot 22
of the County Clerk's Plat of the South Half of Section 26,
Township 45 North, Range 8 East of the Third Principal Meridian,
according to the Plat thereof recorded May 6, 1902 as Document
No. 14084 in Book 2 of Plats, page 38; thence Northeast along the
Southeasterly lineof said Lot 22 and said line extended, for a
distance of 225.13 feet to a point on the Southeasterly line of
the State Highway Routes 31 and 120; thence Northeasterly along
the -Southeasterly line of said State Highway, for a distance of
66 feet to a point; thence Southeast at right angles to the
last described line, for a distance of 94.5 feet to a point on
the Southerly line of a tract of land conveyed by Lydia E. Owen
to Matthais J. Baur by Deed dated February 6, 1922 as Document
No. 53817 in Book 165 of Deeds, page 418; thence Southeast along
said Southerly line, for a distance of 289.82 feet to a point;
thence Southwest along the Southeasterly line of a certain Deed
recorded August 20, 1956 as Document No. 311537 in Book 514, page
451, for a distance of 50 feet; thence Northwest on a line
parallel with the Southerly line of aforesaid Deed dated February
6, 1922 as Document No. 53817 for a distance of 195.52 feet to a
point; thence Southwest in a direct line for a distance of 132.35
feet to the Northeast Corner of Lot 7 of aforesaid E. M. Owen's
Estates Addition to West McHenry; thence Northwest along the
Northerly line of said Addition, for a distance of 199.64 feet to
the place of beginning, in McHenry County, Illinois; ALSO
That piece of parcel of land lying North of Lot 6 of the E. M.
Owen's Estate Addition on the North side of Waukegan Street,
described as follows: Beginning at the Northwest Corner of said
lot 6; thence running Northerly 8 rods in the same direction as the
West side of said Lot 6; thence running Easterly 4 rods parallel
with the North line of said Lot 6; thence running Southerly 8
rods to the Northeast Corner of said Lot 6; thence Westerly 4
rods along the North line of said Lot 6 to the place of beginning,
in McHenry County, Illinois; ALSO
Part of Lot 9 of the County Clerk's Plat of part of the Southwest
Quarter of Section 26, Township 45 North, Range 8 East of the
Third Principal Meridian, according to the Plat thereof recorded
May 6, 1902 as Document No. 14084 in Book 2 of Plats, page 38,
described as follows: Beginning at the most Northerly Corner of
Lot 5 of E. M. Owen's Estate Addition to West McHenry aforesaid;
thence Northerly along an extension of the Westerly line of said
Lot 5, 8 rods; thence Easterly parallel with the Northerly line
of said Lot 5, 4 rods; thence Southerly along an extension of the
Easterly line of said Lot 5, 8 rods to the most Easterly corner of
said Lot 5; thence Westerly, along the Northerly line of said Lot
5, 4 rods to the place of beginning, In McHenry County, Illinois.
SECTION 2: That such Variation and Amendment to the Zoning Ordinance
is made pursuant to affirmative findings of fact required for the granting of
a Variation and upon Affirmative Recommendation of all members of said Zoning
Board of Appeals voting upon the application, following proper Petition
therefore, publication of Notice thereof and public hearing thereon all in
accordance with the provisions of the Zoning Ordinance.
SECTION 3: That all ordinances or parts thereof in conflict here-
with be and the same are hereby repealed.
SECTION 4: That this Ordinance shall be in effect from and after
its passage and approval according to law.
