HomeMy WebLinkAboutOrdinances - O-76-85.25 - 06/08/1976 - AMEND ZONING RECLASS TO B3 AND VARIANCES LOT 13 14AN ORDINANCE L 0-- ,A*- (5; ;�r AMENDING THE ZONING ORDINANCE OF THE C OF McHENRY BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF McHENRY, ILLINOIS AS FOLLOWS: SECTION 1: The Comprehensive Zoning Ordinance of the City of McHenry, Illinois as passed, approved and as subsequently amended and as now in effect, and the zoning map of the City of McHenry, Illinois adopted as a part of said Zoning Ordinance, and as amended, be and they are hereby amended as follows: A. The zoning classification of the following described real estate be and the same is hereby changed to "B-3" Commercial Dis- trict, to -wit: PARCEL B: That part of Lot 5 in County Clerk's Plat of the North Half of Sec- tion 35, Township 45 North, Range 8 East of the Third Principal Meridian, described as follows: Beginning at a point on the West line of said Lot 5 located 150.0 feet North of the Southwest corner of said Lcit 5; thence North 0 degrees 27 minutes 57 seconds East, 226.57 feet; thence North 74 degrees 42 minutes 45 seconds East, 298.64 feet; thence North 90 degrees 00 minutes 00 seconds East along the South line of a private lane (as shown on the Plat o1 Venice Park Addition to McHenry Unit No. 1, according to the Plat thereof recorded February 25, 1941 as Document No. 152920, in IMcHenry County, Illinois) 12.42 feet; thence South 0 degrees 27 minutes 54 seconds 1-,est, 298. 21 -it; thence South 88 degrees 38 minutes 37 seconds West, 300.00 feet the place of beginning, in McHenry County, Illinois; ALSO That part of the Northwest Quarter of the Northeast Quarter of Sec- tion 35, Township 45 North, Range 8 East of the Third Principal Mer- idian, described as follows: Beginning at the Northeast corner of said Northwest Quarter of the Northeast Quarter and running thence South along the East line of said Northwest Quarter of the Northeast Quarter, 589.38 feet to the place of beginning; thence West, parallel with the Section line, 495 feet; thence -Forth parallel with the East line of the iorthwest Quarter of the Northeast Quarter of said Sec- tion 35, 150 feet; thence East parallel with the Section line to the East line of the Northwest Quarter of the Northeast Quarter afore- said; thence South along said East line of the Northwest Quarter of the Northeast Quarter, 150.0 feet to the place of beginning,' in Mc- Henry County, Illinois. SECTION 2: Such change is made following hearing before and the affirmative recommendation of the Zoning Board of Appeals of the City of McHenry, following proper application therefor, publi- cation of notice thereof, and public hearing, all in accordance with the provisions of said Zoning Ordinance. SECTION 3: A variation of the regulations of the Comprehensive Zoning Ordinance of the City of McHenry, Illinois as passed, approved and subsequently amended and now in effect, be and hereby is granted to permit the use of the following described real estate by McHenry Hospital, an Illinois not -for -profit corporation, for offices, pro- fessional offices and medical clinics, more properly described as follows, to -wit: Lots 13, 14 and 15 in Block 2 in Venice Park Addition to McHenry, Unit No. 1, according to the Plat thereof recorded February 25, 1941 as Document No. 152920, in McHenry County, Illinois. SECTION 4: Said use variation is granted following hearing before and the affirmative recommendation of the Zoning Board of Appeals and the City Plan Commission of the City of McHenry, following proper application therefor, publication of notice thereof, and pub- lic hearing, all in accordance with the provisions of said Zoning Ordinance, and upon the finding that: (a) The particular physical surroundings, shapes, or topographical condition of the specific property involved would result in a particular hardship upon the owner as distinguished from a mere in- convenience, if the strict letter of the regula- tions were carried out; ` -2- (b) The conditions upon which the petition for a vari- ation is based are unique and are not applicable generally.to other property within the same zoning classification; (c) The purpose of the variation is not based exclus- ively upon the desire to make more money out of the property; (d) The difficulty or hardship found has not been created by any person presently having an interest in the property; (e) The granting of the variation will not be materially detrimental to the public welfare or injurious to other property or improvements in the neighborhood in which the property is located; and (f) The proposed variation will not impair an adequate supply of light and air to adjacent property, or substantially increase the congestion in the public streets, or increase the danger of fire, or endanger the public safety, or substantially diminish or im- pair property values within the neighborhood. SECTION 5: All ordinances or parts thereof in conflict herewith be and the same are hereby repealed. SECTION 6: This Ordinance shall be in effect from and after its passage and approval according to law. SECTION 7: The authorized and acting City officials of the City of McHenry be and hereby are directed to issue permits, certif- icates and licenses as may be necessary to permit use of the i -3- said real estate as herein described and authorized.
