ORDINANCE
ESTABLISHING A SPECIAL USE UNDER
THE ZONING ORDINANCE OF THE CITY
OF McHENRY, ILLINOIS
WHEREAS, an application has been made requesting the issuance
of a Special Use Permit, as provided in the Zoning Ordinance of the City of
McHenry, Illinois, and such Ordinance as amended, to permit the constructi
operation, and maintenance, of a skilled care nursing home, with all related
II facilities, on the premises described as follows:
i! Parcel 1: Lot "B" in Boone Valley Plat No. 6, a Subdivision
of part of the Northwest Quarter of Section 34 and part of the
Northeast Quarter of Section 33, Township 45 North, Range 8
East of the Third Principal Meridian, and recorded June 10,
!; 1971 as Document No. 544371, in McHenry County, Illinois.
Parcel 2: Lot "C" in Boone Valley Plat No. 6, a Subdivision
of part of the Northwest Quarter of Section 34 and part of the
i� Northeast Quarter of Section 33, Township 45 North, Range 8
i+ East of the Third Principal Meridian, and recorded June 10,
1971 as Document No. 544371 (except that part thereof des-
cribed as follows: Commencing at a point on the Southwesterly
I� line of said Lot "C" South 37 degrees 53 minutes 07 seconds
East 200 feet from the most Westerly corner of said lot;
thence continuing South 37 degrees 53 minutes 07 seconds
East 100 feet; thence North 52 degrees 06 minutes 53 seconds
East 100 feet; thence North 37 degrees 53 minutes 07 seconds
West 100 feet; thence South 52 degrees 06 minutes 53 seconds
West 100 feet to the place of beginning), in McHenry County,
Illinoi s .
AND, WHEREAS, it has been found that all standards concerning
Ithe granting of such Special Use Permit, as set forth in the said Zoning
Ordinance of the City of McHenry, have been complied with by Petitioners;
AND, WHEREAS, a public hearing has been duly held by the Zoning
I Board of Appeals of the City of McHenry and, as a result of the taking of
testimony and viewing of exhibits thereat, the Zoning Board of Appeals has
recommended the issuance of a Special Use Permit by the City of McHenry
to the Petitioners.
NOW, THEREFORE, BE IT ORDAINED by the City Council of the
ICity of McHenry as follows:

That a Special Use Permit shall be issued by the proper
official, or officials, of the City of McHenry to permit
Petitioners to construct on the premises hereinabove
described, a 312 bed skilled care nursing facility, together
with a satellite structure to be utilized for therapeutic and
recreational purposes in connection with the operation of
such facility. Subject to the condition that Petitioner and
their assigns shall pay a sewer hook up fee in connection with
said special use at the rate of $40.00 per patient bed.
BE IT FURTHER ORDAINED that the total facility concerned
shall be served by proper off-street parking spaces to
accommodate 75 vehicles, such number of parking spaces
to be increased, upon order of the City Council, if the said
City Council shall find, not less than two years from and
after the commencement of operation of the facility, that
the said 75 spaces shall not provide adequate off-street
parking.
The passage of this Ordinance was moved by Pepping
seconded by Harker , and upon roll call vote being taken,
