ILLINOIS ORDINANCE AMENDING THE ZONING ORDINANCE OF THE CITY OF McHENRY, ILLINOIS WHEREAS, an application has been made to amend the Zoning 11 Ordinance of the City of McHenry, and such Ordinance as amended, to effect II the reclassification from "R-2" Single -Family District and Special Use II classification to "B- 1" Commercial -Retail District under the said Ordinance, 11 as to the following described premises: �i Parcel 1: The North Half of the following described property: i' Part of the Northwest Quarter of the Southwest Quarter of Section 35, Township 45 North, Range 8 East of the Third Principal Meridian, lying on the Westerly side of the State Highway, des- cribed as follows: Commencing at the West Quarter corner of 11 Section 35; thence Southerly on the West line thereof, 610. 57 feet for a place of beginning; thence Easterly on a line parallel �I with the East and West Quarter Section line, 649. 32 feet to an �i intersection with the West line of State Highway (now known as Route No. 31); thence Southerly on the West line of said State Highway, 133. 85 feet; thence Westerly on a line parallel with I said East and West Quarter Section line, 652.46 feet to the West line of said Section 35; thence Northerly on said Section line, 133. 86 feet to the place of beginning, (except the West 323 feet thereof), in McHenry County, Illinois. ALSO: Parcel 2: The South Half of the following described property: Part of the Northwest Quarter of the Southwest Quarter of Section 35, Township 45 North, Range 8 East of the Third Principal Meridian, in McHenry County, Illinois, lying on the Westerly side of the State Highway described as follows: Commencing at the West Quarter corner of Section 35; thence Southerly on the West line thereof, 610. 57 feet for a place of beginning; thence Easterly on a line parallel with the East and West Quarter Section line, 649. 32 feet to an intersection with the West line of the State Highway (now known as Route No. 31); thence Southerly on the West line of said State Highway, 133. 85 feet; thence Westerly on a line parallel with said East and West Quarter Section line, 652.46 feet to the West line of said Section 35; thence Northerly on said Section line, 133. 86 feet to the place of beginning, (except the West 323 feet thereof), in McHenry County, Illinois. AND, WHEREAS, the provisions of the Zoning Ordinance of the City of McHenry, and such Ordinance as amended, have been found to have been com- plied with by Petitioners, - 1 - z 11 & KJNNE IRNEYS ELM ■TIEmy 1ACKENRY. AND, WHEREAS, a public hearing has been duly held by the Zoning �I Board of Appeals of the City of McHenry and, as a result of such hearing, the Zoning Board of Appeals has recommended denial of the requested reclassifi- I cation, but has recommended an amendment of the Zoning Ordinance which 'I would permit a Variation as to the concerned premises allowing its use for �i professional office building purposes. j� NOW, THEREFORE, BE IT ORDAINED by the City Council of the City �I of McHenry as follows: The Zoning Ordinance of the City of McHenry, and such Ordinance as amended, and the Official Map of the City of McHenry, are hereby amended to indicate a Variation as to the concerned premises which will allow the use of same for remodeling and construction of professional offices, and that the appropriate permit, or permits, for same shall issue for such use when properly requested. The passage of this Ordinance as moved by Harker seconded by Wegener , and upon a vote being taken, the Mayor declared the motion passed. Passed and approved this 17th day of February, 1976.
