AN ORDINANCE
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF Mc HENRY,
ILLINOIS, AS FOLLOWS:
SECTION 1. APPROVAL. The following Intergovernmental
Agreement between the City of McHenry and the Board of Education
of High School District No. 156, McHenry County, Illinois, be
and the same is hereby approved and the Mayor and City Clerk
are hereby authorized to execute said Agreement on behalf of
the City:
INTERGOVERNMENTAL AGREEMENT
Agreement between the corporate authorities of the City
of McHenry, Illinois, a municipality (hereinafter called City
and the Board of Education of High School District No. 156,
McHenry County, Illinois (hereinafter called School Board).
City and School Board are each units of local government
as defined under Article VII of the Illinois Constitution of
1970.
Under said Constitution Article VII §10, the City and
School Board are permitted to contract with each other to
obtain or share services and to exercise, combine or trans-
fer any power or function in any manner not prohibited by law.
Under Chapter 95 1/2 §11-209 Illinois Revised Statutes
1971, City and School Board are authorized to enter into a
contract for the City to regulate traffic and the parking of
automobiles in any parking area controlled by the School Board
inside the corporate limits of the City: School Board desires
to authorize the City to regulate the parking of automobiles
in the parking area and entrances thereto at the School Board's
East and West Campuses within the City limits of the City of
Mc Henry .
NOW, THEREFORE, it is hereby agreed by and between School
Board and City, as follows:
1. The following parking areas controlled by the School Board
inside the corporate limits of the City are hereby designated and
established as fire lanes, upon which there shall be no standing
or parking of any motor vehicle at any time so that fire fighting
equipment can move freely thereon:
(a) West Campus. An area ten feet in width abutting on the

entire length of the sidewalk located at the front, or East
side, of the West Campus High School Building, and, in addition
thereto, the entire parking area to the rear, or West Side,
of said West Campus High School Building, from the South Park-
ing Lot on said Campus to the Northernmost part of said rear
parking area (except a part therof 25 feet in width along the
Western boundary of said rear parking area for a distance of
90 feet from the Northwest corner thereof).
(b) East Campus. An area located at the rear, or East
side, of the East Campus High School Building, described as
follows: beginning at the easternmost Northeast corner of said
building for a place of beginning; thence easterly at a right
angle from the eastern wall of said building a distance of 20
feet; thence Southerly at a right angle to the last described
line a distance of 232 feet to a point; thence Westerly at a
right angle from the last described line to the aforesaid build-
ing, a distance of approximately 60 feet; thence in a Northerly
course along the wall of said building to the point of beginning.
2. Any person parking a motor vehicle in the above described
fire lanes shall be punished as a violator of the parking rules
established by the City of McHenry Ordinance Number MC-48, common-
ly known as the Motor Vehicle and Traffic Regulation of the City
of McHenry, Illinois, and shall be fined, as therein provided,
not less than Five Dollars ($5.00) nor more than Five Hundred
Dollars ($500.00) for each violation.
3. This Agreement may be terminated by either party upon 30
day written notice to the other, provied, however, that the term
of this Agreement shall not, in any event, exceed a period of
twenty years from the date of this Agreement.
4. The terms of this Agreement shall be effective and en-
forceable three days after this Agreement is recorded in the Office
of the Recorder of Deeds of McHenry County, Illinois; it shall be
an offense thereafter for any person to do any act forbidden here-
under or to fail to perform any act required by the parking re-
quirements hereunder; the fine for any offense hereunder shall be
as established under the Municipal Code of McHenry,
5. All notices hereunder shall be in writing and shall be
sent certified or registered mail, postage prepaid, or delivered
personally to the City at the City Hall, 1111 N. Green Street,
McHenry, Illinois, and to School Board at McHenry Community High
School, 3926 West Main Street, McHenry, Illinois 60050.

SECTION 3. Any person parking a motor vehicle in the
fire lanes shall be punished as a violator of the parking
rules established by the City of McHenry Ordinance Number
MC-48, commonly known as the Motor Vehicle and Traffic
Regulation of the City of McHenry, Illinois, and shall be
fined, as therein provided, not less than Five Dollars
($5.00) nor more than Five Hundred Dollars ($500.00) for
each violation.
SECTION 4. VALIDITY. Should any section, clause or
provision of this Ordinance be declared by a court of com-
petent jurisdiction to be invalid, such decision shall not
affect the validity of the Ordinance as a whole, or any part
thereof, other than the part so declared to be invalid.
SECTION 5. Any Ordinance or part of any Ordinance in
conflict herewith is hereby repealed.
SECTION 6. This Ordinance shall take effect and be in
full force from and after its passage, approval, publication
and recording in the Office of the Recorder of Deeds of McHenry
County, Illinois, as provided by law.

6. Costs of any signs or traffic markings required in
order to implement the terms hereof shall be borne by School
Board. The cost of publication of this Agreement shall be
paid by School Board.
7. Execution, delivery and recording of this Agreement
has been authorized by an Ordinance duly adopted by the corpo-
rate authorities of the City of McHenry, Illinois, and a
Resolution duly adopted by the Board of Education of High School
District No. 156, McHenry County, Illinois

SECTION 2. It shall be unlawful for any person to park a
motor vehicle, at any time, in the fire lane areas described in
paragraph 1 of the Intergovernmental Agreement set forth in
SECTION 1 of this Ordinance.
