Being an Ordinance Varying
the Provisions of the Zoning
Ordinance of the City of McHenry
WHEREAS Application for Variation of the Zoning Ordinance
of the City of McHenry was duly filed and regularly heard by the
Zoning Board of Appeals pursuant to proper notice, wherein a variation
was sought with reference to Lot 13 in Block 2, in Lakeland Shores,
Unit No. 3, to permit storage of trucks and vehicles upon said property.
WHEREAS said Zoning Board of Appeals found that the said
property is presently zoned business "B-1"
WHEREAS the said Zoning Board of Appeals did further find:
a. the particular physical surroundings, shapes, or topo-
graphical condition of the specific property involved would
result in a particular hardship upon the owner, as distinguished
from a mere inconvenience, if the strict letter of the regulations
were carried out;
b. the conditions upon which the petition for a variation is
based are unique and would not be applicable, generally, to other
property within the same zoning classification;
c. the purpose of the variation is not based exclusively
upon a desire to make more money out of the property;
d, the alleged difficulty or hardship has not been created
by any person presently having an interest in the property;
e. the granting of the variation will not be materially det-
rimental to the public welfare or injurious to other property or
improvements in the neighborhood in which the property is located;
and
f. the proposed variation will not impair an adequate supply
of light and air to adjacent property, or substantially increase
the congestion in the public streets, or increase the danger of
fire, or endanger the public safety, or substantially diminish or
impair property values within the neighborhood.
BE IT THEREFORE ORDAINED
1. That variation in the Zoning Ordinance of the City of
McHenry pertaining to the following described property:
Lot 13 in Block 2 in Lakeland Shores, Unit No. 3, being
a subdivision of part of the North Half of the Southwest
Quarter of Section 27, Township 45 North, Range 8 East of
the Third Principal Meridian, lying South of the center line
of State Route 120, according to the Plat thereof recorded
April 25, 1958 as Document No. 337444 in Book 13 of Plats,
page 55, in McHenry County, Illinois
be granted to permit the storage of trucks and vehicles upon said
property.
