AN ORDINANCE
WHEREAS, it is to the best interests of the City of
McHenry, Illinois that the portion of South Street herein-
after described be vacated;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF
THE CITY OF McHENRY, ILLINOIS as follows:
1. The street previously known as South Street between
the Southwesterly line of Mill Street and the Northeasterly
line of Logan Street in the City of McHenry, Illinois be and
the same is hereby vacated; provided, however, that the City
of McHenry, Illinois retains the right to maintain, operate,
repair and replace, by itself or by any licensee or a holder
of a franchise from the City, any poles, wires, pipes, conduits,
sanitary and storm water sewer mains, water mains, or anyother
facility or equipment for the maintenance or operation of any
utility now or hereinafter located in the street or portion
thereof vacated by this ordinance; and further provided that
the City retains the right to maintain, operate, construct,
repair and replace by itself, or by any licensee or holder of
a franchise from the City any surface water drainage structures
in the street or portion thereof vacated by this ordinance.
2. That this ordinance shall be in full force and effect
from and after its passage and approval as by law provided.
