HomeMy WebLinkAboutOrdinances - O-74-66.75 - 12/30/1974 - GRANT SPEC USE FOR YOUTH HOUSE ON MAIN STMcHenry No. AN ORDINANCE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF McHENRY, ILLINOIS , as follows: SECTION 1. That the Comprehensive Zoning Ordinance of the City of McHenry, Illinois, as passed, approved and as subsequently amended and as now in effect, and the zoning map of the City of McHenry, Illinois, adopted as a part of said Zoning Ordinance, and as amended, be and they are here- by amended as follows: A. That a special use be and the same is hereby granted t and extended to the following described premises to permit its temporary use for the purpose of conducting casual recreation center activities for an organization of high school aged persons, to -wit: Youth Organization United Through Hope, Inc., an Illinois not for profit corporation: A part of Lot 1, described as follows: Beginning on the Southerly line of Main Street at a point 118 feet Easterly from the Northwest corner of saiO Lot 1; running thence Southerly on and along the Easterly line of a lot of land deeded by William Tesch and wife, to Henry Heimer by Warranty Deed dated the llth day of September A.D. 1906 and recorded in the Recorder's Office of McHenry County, Illinois, in Book 118 of Deeds on page 477, a distance of 132 feet, more or less, to the Southerly line of said Lot 1; running thence Easterly on and along the Southerly line of said Lot 1, a distance of 66 feet; running thence North 15-3/4 degrees East 132 feet, more or less, to the Southerly line of the aforesaid street; running thence Westerly on and along the Southerly line of the afore- said street 66 feet to the place of beginning in Block 8 in the Original Plat of West McHenry, being a part of the Southwest Ouarter of Section 26 and the Northwest Quarter of Section 35, Township 45 North, Range 8 East of the Third Principal Meridian according to the Plat thereof recorded June 14, 1859 in Book 24 of Deeds, page 22, in McHenry County, Illinois. B. That the aforesaid special use may be made of the aforesaid property on the following terms and conditions: 1. That the term of such special use shall not exceed a period of one year from the date of this ordinance. 2. That Youth Organization United Through Hope, Inc. shall enter into a lease of the premises in question with the Board of Library Directors of the City of McHenry upon such terms and conditions as said Board of Library Directors shall determine, provided, however, that -such lease shall be for the term of a month to month, and shall be subject to termination upon the sole discretion and will of the Board of Library Directors. 3. That Youth Organization United Through Hope, Inc. shall obtain such fire and public liability insurance coverage and in such amounts as the Board of Library Directors of the City of McHenry shall require. 4. That persons using the property in connection with said special use shall not park their automobiles on the premises in question nor on Main Street but -2 - shall instead park their automobiles at the Jr. High School parking lot. 5. That the hours during which the premises in question are used for the special use shall be subject to the approval of the Board of Library Directors. 6. That the use of said premises for the special use in question shall comply with the Rules and Regula- tions of the McHenry Fire Protection District. C. That the foregoing conditions shall be binding upon the successors or assigns of Youth Organization United Through Hope, Inc. SECTION 2. That the special use herein is granted following a hearing before .the Zoning Board of Appeals of the City of McHenry following a proper application therefor, publication and mailing of notice thereof, and public hearing, all in accordance with the provisions of said Zoning Ordinance. SECTION 3. That all ordinances or parts thereof in conflict herewith be and the same are hereby repealed. SECTION 4. That this ordinance shall be in effect from and after its passage and approval according to law. PASSED this 30th day of December, 1974.
