AN ORDINANCE AMENDING THE ZONING ORDINANCE
OF THE CITY OF McHENRY, ILLINOIS AND
SUCH ORDINANCE AS AMENDED
In the matter of the application of the ADiance
Bible Church of the Christian and Missionary
Alliance, The First Arlington National Bank of
Arlington, Heights, Illinois, a National Banking
Association as Trustee under Trust Agreement
dated the 25th day of May, 1972, and known as
Land Trust #a-239, the beneficiaries of the afore-
mentioned Land Trust, Ralph L. Edgar and Denis J.
Rintz, for special use permit under the Zoning
Ordinance of the City of McHenry, Illinois and
such ordinance as amended.
WHEREAS, Petitioners did file a petition requesting
a Special Use Permit and therefore requesting an amendment to
the Zoning Ordinance of the City of McHenry, and such Ordinance
as amended in regard to the premises which are more fully de-
scribed in Exhibit"A", which is attached hereto and incorporated
herein by reference; and
WHEREAS, the petition requested a Special Use Permit
for the construction of a place of worship and other buildings
consistent therewith; and
WHEREAS, a hearing was had before the Zoning Board of
Appeals for the City of McHenry in the manner and form as
prescribed by Ordinance and Statute; and
WHEREAS, the Zoning Board of Appeals pursuant to
said hearing and evidence made the following findings:
1. The proposed use of the property in question
will not hinder or discourage the appropriate development and use
of adjacent land and building and will not impair the value thereof.
2. The condition of the classification of the sur-
rounding property pose no foreseeable question as to the availability
of business property for liquor license, such property being suf-
ficiently removed from Church property.
3. Adequate space for parking is included in the
present plans in order to allow 1 vehicle space for every 3 seats
in the church.
4. Proper exit and entrance drives are to be
provided as well as a legal hard surfaced parking area.
5. Adequate scrrening will be planted for the
benefit of adjacent residence property.
6. No "Coffee House" activities will be continued
at the new location of the Alliance Bible Church.
WHEREAS, as a result of such hearing, the taking of
evidence, and the viewing of exhibits as advanced thereat, the
Zoning Board of -Appeals of the City of McHenry recommend to the
City Council of the City of McHenry the granting of said request
for Special Use Permit; and
WHEREAS, the City Council for the City of McHenry has
fully considered the recommendation as submitted by the Zoning
Board of Appeals ;
NOW, THEREFORE, be it ordained, by the City Council of
the City of McHenry that the Zoning Ordinance of the City of
McHenry, as passed and approved on the 12th day of March, 1962,
and such Ordinance as subsequently amended, be and is hereby
amended as follows:
I. That the premises as described in Exhibit "A",
attached hereto and made a part hereof by this
reference, are hereby given a Special Use Permit
for the construction of a place of worship and
other buildings consistent with such a place of
worship pursuant to Article XV, Subparagraph A 2
of said Zoning Ordinance.
II. That such Special Use Permit is hereby granted
subject to the following limitations:
a. That a residence building shall not be built
on the premises.
b. That construction shall be consistent with the
necessary entrance, exit, parking and screening
requirements which are a part of the Zoning
Ordinance of the City of McHenry and such
Ordinance as amended.
III. That all ordinances or parts thereof in conflict
herewith be and the same are hereby repealed.

IV. That this Ordinance shall be in full force and
effect from and after its passage and approval
according to law.

That part of the Northeast Quarter of the Northwest Quarter of
'ection 26, Township 45 North, Range 8 East of the'Third Principal
eridian, described as follows: Commencing at the Northwest Corner
of said Northeast Quarter of the Northwest Quarter and running thence
South along the West line of said Northeast Quarter of the Northwest
Quarter 76.695 feet to the point of intersection of said West line
with the center line of McCullom Lake Road; Continuing thence South
along said West line 41.323 feet. to the point of intersection with
the Southwesterly 33 foot right of way line of said road for the place

said West line of the Northeast Quarter of the Northwest Quarter
451.012 feet; thence East on a straight line which forms an angle of
88 degrees 49 minutes 16 seconds measured from North to East with
said West line 571.379 feet to a point of intersection with said South-
westerly right of way line; thence Northwesterly on said right of way
line the same being the arc of a circle, convex Northeasterly and
having a radius of 5696.65 feet for a distance of 281.872 feet to a
point of tangency; continuing thence Northwesterly in a straight line
which forms an angle of 52 degrees 59 minutes 47 seconds measured from
South to East with said West line of Northeast Quarter of the Northwest
Quarter 438.828 feet to the place of beginning, in McHenry County,
