HomeMy WebLinkAboutOrdinances - O-73-58 - 12/17/1973 - ESTABLISH ELECTRIC CODE BY REFERENCEAN ORDINANCE - - BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF MCHENRY, ILLINOIS, as follows: Section 1. That pursuant to the recommendation of the Electrical Commission of the City, Chapter 14, Article IV, Section 18 of the Municipal Code of the City of McHenry, be and the same is hereby amended to read as follows: 18.1. Adoption of National Electrical Code by Reference. The National Electrical Code, 1971 Edition, promulgated by the National Fire Protection Association, and amendments thereto, are hereby adopted by reference as and for the safe and practical standards for the installation, alteration and use of electrical wiring, apparatus and equipment in the City, provided however, that where the provisions of the said National Electrical Code 4nd amendments thereto are in conflict with the provisions of Sections 18.2 throu&h18.8 hereof, and of such amendments here- of as the City may hereafter adopt, said Section 18.2 through 18.8 hereof and said amendments hereto as may hereafter be en- acted by the City, shall control. Three copies of the aforesaid National Electrical Code, 1971 Edition, and of all amendments thereto subsequently enacted, are filed in the office of the City Clerk for public use, inspect- ion and examination, and have been so filed with the City Clerk for a period of 15 days prior to adoption of this Ordinance. 18.2. Electrical Service, Wiring and Grounding. The follow- ing exceptions and modifications are found necessary to meet con- ditions and shall prevail in the case of conflict thereof with any of the provisions in the aforesaid National Electrical Code: (a) All commercial, industrial and multi -family residence service shall, be in rigid conduit; all interior wiring in commercial, inaustrial and multi -family residences shall be in thinwall (EMT) con- duit. (b) Single-family residence service shall be in rigid or in thinwall (EMT) metal conduit; all interior wiring in Single-family residences shall be in EX or in thinwalli(EMT) conduit or shall be ,grounded Romex. CERT. OF pUBLICAT40N ATTACHED TO ORIGINAL (c) All underground wiring shall be in rigid conduit. (d) All metal noncurrent carrying parts of enclosures of electrical equipment and metal boxes shall be grounded. T:,e ground wire shall be secured Lo a cold water pipe when much pipe is available; if such pipe is not available, then the ground shall be secured to a ground rod at least eight root length. No ground shall be secured to any fixture or fitting. Electrical Post Lites must be grounded by means of direcc. burial ground (UF) or rigid conduit. All buildings having metal siding shall be grounded by means of two ground rods, eight feet in length, located on opposite corners. (e) All electrical outlets, switches and'light fixturcc:, shall be provided with metal boxes, which shall be grounded. (f) Wiring for dining rooms, kitchens, laundries ana uUi11ty.rooms in all residences shall not be smaller than No. 12 AWG wire and no more than three appliance outlets shall be located on any separate individual circuit. All furnaces, boilers, washers, diswashers, air -conditioners, wells and suzi,) pumps shall be wired on separate circuits of wire not smaller than No. 12 AWG. (g) The existing type of wiring may be followed where additional outlets are being installed in any existing structurc. However, where a building addition is being constructed, the, uy,)C of wiring in the existing structure shall not be followed such existing wiring complies with the provisions of thin ance. 18.3. Electrical Inspection Department Established. Tlki,.� there is hereby established an Electrical Inspection Depa; L.,,c!nt V'< 2 the regulation of the installation, alteration and use of all electrical wiring, apparatus and equipment as herein providcu. Such Me ctrical Inspection Department shall consist of the -2- ylectr_L Inspector of the City and such other employees a- may, from time to time, be provided for by the City Council, anu shall be a division of the Depart-ment of Public Works Inspection under the supervision of said department. Suc:: Electrical Inspection Department shall be charged with tac duty of enforcing the provisions of the rules and regulationL; relating to the installation, alteration and use of electrical equipment, as provided for in this Ordinance and shall function under the immediate supervision and control of the Electrical inspector. The Building Inspector shall act as the Electrical Inspector and shall have all of the powers and perform all of the duties connected with that office. 18.4 Rough -in Inspections. No electrical installation or alteration shall be covered up or concealed before the cl:c- tracal wiring, equipment and apparatus has been inspected and approved by the Electrical Inspection Department. Whenever an electrical installation or alteration, ready for a rough -in inspection, a request for such inspectc,', L>hall be made to the Electrical Inspection Department a-;, one full work day in advance thereof. The rough -in inspection 3 all be made as soon thereafter as it is practical for the department to do so. Any electrical installation or alteration which haL_5 ►; c.. concealed or covered up in violation of the provisions of erection, shall be completely opened up and uncovered by er of the premises upon the request of the Electrical Department. In addition thereto, the initial failure v.- any electrical installation or alteration uncovered or opencu or inspection, shall be punishable by the payment of the :;►;� provided for in Section 18.8 hereof. 18.5. Temporary and Permanent Service. It shall be ful for any person to turn on electrical power into any elc.c�.•_c wire or apparatus for temporary or for permanent electrical vice-, unless a Certificate of Approval has first been issued Vc,..• -3- such purpose by the Electrical Inspection Department. When temporary or permanent electrical service is desired, it shall be the responsibility of the electrical contractor,or other installer, performing the electrical work, to make a request to the Department for an inspection of the electrical work, said request to be at least one full working day in advance of the requested inspection. No Certificate of Approval for such temporary or permanent el- ectrical service shall be issued until after the department has completely inspected the electrical work and until such Inspection discloses that the provisions and requirements of this Ordinance have been fully complied with. Certificates of Approval shall be issued in duplicate. One copy thereof shall be retained as part of the records of the department, and the other copy shall be delivered to the Electric Utility Company. No Electric Utility Company shall energize any temporary or permanent electric service until it has received a copy of the aforesaid Certificate of Approval. 18.6. Annual Inspections. The electrical installat.ion:L in all buildings and structures located in areas that are zon(%,, for industrial, commercial or multi -family dwellings (where the dwelling consists of more than two units) uses shall be subject to annual re -inspection by the Electrical Inspection Department. Changes and alterations in the electrical installations may be ordered by the Electrical Inspection Department as a consequence, of such annual inspection where the public safety requires .4drLt- ten notice of such changes or alterations shall be given to Lhe owner of the premises by the Electrical Inspection Department, and such changes or alterations shall be made within thirty 6LYS after said written notice is given. The Electrical Inspection Department shall have the power to cause the current in any vrirc or conductor to be turned off wherever this becomes necessary, in his judgment, for the protection of life, limb or property. All changes and alterations made pursuant to such notice shall be inspected and approved by the Electrical Inspection Depart- ment. 18.7. Licensing and Registration of Electrical Con- tractors. It shall be unlawful for any person, firm, or cor'>- oration to engage in Lhe business of installing electric•_ conductors, in the City, to be used for light, heat oi, or to engage in the business as an Electrical Contractor out first having obtained a City License therefor; proviue however, that if such person, firm, corporation or electrical contractor is then licensed in another Illinois Nunicipalit-.y as an Electrical Contractor, it shall not be necessary for such licensee to obtain an Electrical Contractors License from the City of McHenry, or to pay a license fee during the term of said foreign license. All applications for an Electrical Contractors Licensc ahall be made to the Electrical Inspection Department upon forms provided by said Department for that purpose. Upcw: ;,Q- ceipt of an application for a license hereunder, the De-,). i :.- ment shall refer such application and applicant to the Ci..;r Electrical Commission, for investigation and for such of electrical knowledge and work proficiency as may be ;.101J.ii• u by the said Commission. If the applicant is found by the mission to be qualified for an Electrical Contractor. Lac.:.►., , it shall instruct the City Clerk to enroll the name of �►c applicant on the register of Licensed Electrical Contrac�o,­:,,, and to issue to such applicant a Certificate of Registratlo.:. The term of the Electrical rical Contractors License s�..11 'Cla Calendar Year, and the annual fee for such license y $25.00, except that where a license is issued for less th.n full term, the $25.00 gee shall be prorated on the basis ):'., ber of months remaining in the calendar year for which tnc is issued. Any person, firm, corporation or contractor who shall violate any provision of this Ordi- nance, or fail, no-lect, or refuse to comply with any oiLxL: c tl:e :,aid Electrical inspection Department, its pursua,ic. o.f and by authority of any of the provisions herein con►,ain.,u, shall be subject to a fine of not less than Ten Dollars ($10.00), nor more than Five Hundred Dollars ($500.00) for each offense. Section 2. All Ordinances or parts thereof in conflic'., with this Ordinance, be and the same are, hereby repeale.11 effective January 1, 1974. Section 3.
