HomeMy WebLinkAboutOrdinances - O-71-47.25 - 06/07/1971 - GRANTED VARIANCE UNITED PENTECOSTAL CHURCHMJS/eh OSLY, 1 f OODS BEEN ' -INOIS IN THE NLATTER OF THE APPLICATION ) OF MAY DEVELOPMENT COMPANY, AN ) ILLINOIS CORPORATION, EARL REED ) AND LAVERNE REED, HIS WIFE, AND ) UNITED PENTECOSTAL CHURCH, A RELI-) GIOUS CORPORATION, FOR A VARIATION) UNDER THE ZONING ORDINANCE OF THE ) CITY OF MCHENRY, ILLINOIS AND SUCH) ORDINANCE AS AMENDED. ) O R D--I N A N C E WHEREAS, Petitioners filed a Petition with the Zoning Board of .appeals of the City of "AcIlenry requesting a variation under the provisions of the City of McHenry Zoning Ordinance, and such Ordinance as amended, in regard to the following described property; -- The South one-half of Lot 1 in Block 21 in Lakeland Park, Unit No. 2, a Subdivision of part of the North- west Quarter and part of the Southwest Quarter of Section 27, Township 45 North, Range 8 East of the Third Principal Meridian, according to the Plat there- of recorded on'December 12, 19S2 as Document No. 260030 in McHenry County, Illinois. AND, WHEREAS, a hearing was held before the Zoning Board of Appeals of the City of McHenry in regard to the contents of the Petition, and evidence was introduced by the Petitioners at such hearing in support of their position; AND, WHEREAS, as a result of said hearing and after consider- ation of the contents of the Petition and evidence presented in support of the Petition, the Zoning Board of Appeals of the Cite of 'McHenry did find that a variation, if granted, would comply with all standards and requirements in regard to the granting of variations as established by the Zoning Ordinance of the City of McHenry; AND, WHEREAS, the Zoning Board of Appeals of the City of Mc- Henry has recommended that the variation requested be granted to the Petitioners, with the limitation that said variation be effect ive from the date of occupancy of said premises by the Petitioner, UNITED PENTECOSTAL CHURCH, a Religious Corporation, to January 1, 1973, such recommendation having been filed with the City Clerk of the City of McHenry and having been considered by the City Council of the City of McHenry. -2- NOW, THEREFORE: BE IT ORDAINED, that the provisions and requirements of the Zoning Ordinance of the City of McIienry, and such Ordinance as amended, concerning the use and lot area requirements in regard to the premises as hereinabove described, be and hereby are, varied to permit Petitioner, Ui�ITED PENTECOSTAL CHURCH, a Reli- gious Corporation, to use said premises as a Church. Provided, however, that said variation shall be effective from January 1, 1971, the date on which the Petitioner, UNITED PENTECOSTAL CHURCH, a Religious Corporation, took occupancy of said premises; and, further, that said variation shall expire on January 1, 1973. This Ordinance shall be in full force and effect from and after its passage as provided by law. DATED this I— day of June, 1971.
