AN ORDINANCE AMENDING THE ZONING
ORDINANCE OF THE CITY OF McHENRY
WHEREAS, a Petition was heard by the Zoning Board of Appeals
of the City of McHenry in regard to a variation of certain provisions of
the Zoning Ordinance of the City of McHenry as originally passed and
approved on the 12th day of March, 1962, and as subsequently amended,
and
WHEREAS, as a result of such hearing, and in consideration of
the evidence advanced to the said Zoning Board of Appeals at said hearing,
a recommendation for variation of the requirements under the Zoning
Ordinance of the City of McHenry has been given to the City Council of
the said City by the Zoning Board of Appeals, and
WHEREAS, it is the position of the City Council of the said City
that the recommendation as given is reasonable and valid;
NOW, THEREFORE, BE IT ORDAINED by the City Council of
the City of McHenry, Illinois, that a variation be given to the Petitioner
which will permit the Northern -most 2500 square feet of its existing
building, described as follows:
Lots 4 and 5 in Matt Baur's Addition to the City of
McHenry, a Subdivision of part of the Southwest Quarter
of Section 26, Township 45 North, Range 8 East of the
Third Principal Meridian, according to the Plat thereof
recorded February 2, 1932 as Document No. 100509,
in Book 7 of Plats, page 42, in McHenry County, Illinois,
to be utilized by Jewel Companies, Inc. for the storage of merchandise,
and for no other purposes. Provided, however, that this variation shall
extend only to such usage by Jewel as given under its present lease, or
such lease as extended. At the termination of the said lease, or its
extensions, the variation shall cease and determine.

THIS ORDINANCE shall be in full force and effect from and after
its passage and approval, as by statute provided.
PASSED AND APPROVED this 7th day of December, 1970.
