AN ORDINANCE VARYING THE APPLICATION OF THE
ZONING ORDINANCE OF THE CITY OF McHENRY, ILLINOIS WITH
REGARD TO CERTAIN REAL ESTATE IN SECTION 26, IN THE CITY
OF McHENRY, COUNTY OF McHENRY, ILLINOIS
WHEREAS the First National Bank of Woodstock as Trustee under
Trust No. 533 filed a verified petition for an Amendment to the
City of McHenry Zoning Ordinance as to certain real estate here-
inafter described to change the zoning classification from the
presently existing B-3 (Commercial classificiation) to R-4
(Multiple family district classification); and
WHEREAS the Zoning Board of Appeals set a time and place for
the Zoning Hearing pursuant to said Petition as provided for in
the Ordinance; and
WHEREAS due and proper notice of said hearing was given to
all interested parties in accordance with said Zoning Ordinance
of the City of McHenry and the rules of the Zoning Board of
Appeals; and
WHEREAS the said Zoning Board of Appeals has held a hearing
provided for by the said Ordinance and has recommended to the
City Council that a reclassification be granted pursuant to the
petition of the FirstNational Bank of Woodstock as Trustee under
Trust No. 533, granting all of the uses permitted in the R-4
multiple family district classification, pursuant to the Zoning
Ordinance, further stipulating that off-street parking areas
shall be graded for proper drainage, and oiled or in some other
manner be made dust free; and
WHEREAS the City of McHenry Zoning Board of Appeals has
found that practical difficulties and particular hardship not
intended and not common to the owners of property in the vicinit3
would be imposed upon petitioner in carrying the strict letter
of the regulations now zoning and districting the real estate
hereinafter described, and that a reclassification should be
granted to said First National Bank of Woodstock as Trustee
under Trust No. 533 as herein set forth, and that the proposed
reclassification would not:
(a) Impair an adequate supply of light and air to
adjacent property
(b) Increase the hazard of fire or other hazards to
said property
(c) Diminish the value of land and buildings throughout
the city
(d) Increhse the conjestion of traffic hazards in the
public streets and highways
(e) Otherwise impair the public health, safety, comfort,
morals and general welfare of the inhabitants of
said city
NOW THEREFORE, BE IT ORDAINED by the City Council of the
City of McHenry, County of McHenry, State of Illinois, as
follows:
-1. That all of the findinas of the City of McHenry Zoning
Board of Appeals hereinbefore set forth are found to be true
and are adopted by the City Council of theCity of McHenry,
Illinois.
2. That the Zoning Ordinance of the City of McHenry as
presently enforced be and the same is hereby reclassified as to
the following described real estate, towit:
Lot 5 (excepting t4refrom a strip of land 20 feet in
width off from the entire northwesterly side thereof,
the Easterly line of strip of land being parallel with
and 20 feet distant from the Northwesterly line of said
lot) in Block 5 in the Original Plat of the Village of
West McHenry, a subdivision of part of the Southwest
Quarter of Section 26, Township 45 North, Range 8, East
of the Third Principal Meridian according to the plat
thereof recorded June 14, 1859 in Book 24 of Deeds, page
22, in McHenry County, Illinois
to R-4 (Multiple Family District Classific:ation), to allow any
of the uses permitted in said R-4 classification as defined and

set out in the Zoning Ordinance of the City of McHenry,Illinois.
3. That all journals, maps and other records of the Zoning
Department of the City of McHenry be changed to show said
reclassification.
4. That this Ordinance shall be in full force and effect
from and after its passage and approval as provided by law.
PASSED by the City Council of the City of McHenry, County
of McHenry, State of Illinois, and APPROVED by me this Aa—
