L -�} THE VARIATION AMENDING THE ZONING ORDINANCE IN
THE CITY OF McHENRY, ILLINOIS
WHEREAS, a petition was filed and a proper public
hearing was held concerning certain premises identified as
3922 "-dest Main Street, and legally described as follows:
That part of Lot 17, described as follows:
Beginning at the most iJesterly Corner of said
Lot 17; thence Northerly along the Northwesterly
line thereof, a distance of 85 feet; thence
Easterly at right angles to last described line,
a distance of 33 feet; thence Southerly at right
angles to last described line, a distance of
85 feet to the Northerly line of Main Street;
thence ',Jesterly along the Northerly line of
'.:ain Street, a distance of 33 feet to the place
of beginning, in Block 3 in the Original Plat of
J'est McHenry, being a part of the Southwest
Quarter of Section 26 and the Northwest Quarter
of Section 35, Township 45 North, Range 8 East
of the Third Principal Meridian, according to
the Plat thereof recorded June 14, 1859 in
Book 24 of Plats, page 22, in McHenry County,
Illinois.
AND, WHEREAS, the said petitioner requested a
variation under the existing "B-3" zoning classification
which would permit petitioner to utilize commercially the
apartment portion of the premises in the rear -of the existing
structure,
AND, WHEREAS, the zoning board of appeals has
recommended that the variation requested be allowed by the
City of McHenry, subject to specific limitations,
NO,a , THEREFORE,
BE IT RESOLVE by the City Council of the City of
McHenry that the premises described above be given a variation
to permit the commercial use of the existing apartment facilities
in the rear of the structure now on the premises;
PROVIDED, HOWEVER, that such variations in use
shall cease and determine in the event the alleyway to the
East of the premises and the vacant property to the North
of the premises shall not be available for use by the
occupants of the apartment.
Passed and approved by the City Council of the City
of McHenry on this 7th day of July, 1969.
