HomeMy WebLinkAboutOrdinances - O-67-36.B - 11/06/1967 - PUD(� "4�; 7— 36,L3 I; AN ORDINANCE AMENDING THE ZONING ORDINANCE OF THE I CITY OF McHENRY, ILLINOIS I' li BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE !'CITY OF McHENRY, ILLINOIS, AS FOLLOWS: SECTION 1: That the Zoning Ordinance of the City of McHenry, I Illinois, heretofore adopted on the 12th day of Niarch, 1962, and the Zoning! ' Map adopted as a part thereof, and as said Zoning Ordinance and as said Zoning Map have been subsequently amended, be and they are hereby amended as follows: A. That the property described in "Exhibit A" hereto attached and made a part hereof be and the same is hereby classified as a Planned 0 Unit Development under the provisions of Article XV entitled, "Special Uses'', paragraph E entitled, ''Planned Unit Development". SECTION 2: That such special use is authorized upon the finding that: A. The special use will not cause substantial injury to the value of other property in the neighborhood in which it is located. B. The location and size of the special use, the nature and !'intensity of the operation involved in or conducted in connection with it, `I the size of the site in relation to it, and the location of the site with respect I� I! 1�to streets giving access to it, shall be such that it will be in harmony with I� . :'the appropriate and ordinary development of the district in which it is located. Parking areas shall be of adequate size for the particular use,1 I properly located, and suitably screened from adjoining residential uses, and the entrance and exit drives shall be laid out so as to prevent traffic I hazards and nuisances. E. The uses permitted by any exceptions are necessary and ;desirable and appropriate to the purpose of the development. F. The uses permitted in the development are not of such nature or so located as to exercise a detrimental influence or effect upon the I li surrounding neighborhood. I G. That no industrial areas will be established in the Planned Unit Development. !i H. That all minimum requirements pertaining to commercial, i, residential, institutional or other uses established in the Planned Unit II Development will be subject to the requirements for each individual classi-! 1iification as established elsewhere in this Ordinance, except as may be Specifically varied hereinafter, i I I � SECTION 3: That the uses of the areas delineated shall be, and they are hereby, established as follows: Commercial, Multiple Family Residential, Single Family Residential, Public Park, Public Open Space, i and School; and that these use areas be, and are hereby, established as shown upon the Use Area Map hereto attached and made a part hereof as �I "Exhibit D". j' SECTION 4: That the Planned Unit Development area may be developed in the stages or phases in accordance with the areas relating to such phases as are shown on "Exhibit D" as attached hereto and made a .:part hereof by this reference. , - 2 - LOOZE & KINNE ATTORNEYS W. ELM STREET (. ILLINOIs SECTION 5: That said Planned Unit Development is authorized as a special use upon the following conditions: A. That the park areas designated "A", "B" and "C", as delineated on "Exhibit D", shall be dedicated to the City of McHenry on the recorded plat of such phase as shall be developed and platted in accordance with this Ordinance, and at such time as such phase proceeds to development. The City of McHenry shall not be obligated to accept such dedications in the event the physical condition of such property shall be deemed inefficient or unacceptable by the City of McHenry. The classification and disposition of Parcel "D" as delineated on "Exhibit D" shall be deferred pending a final determination as to use by McHenry Community High School District No. 156 or McHenry Community Consolidated Grade School District No. 15. it B. That the uses permitted in the commercial area located in ,I l Phase 1 on "Exhibit D" shall be those uses permitted in the "B-1" it .I Commercial Retail District of the said Zoning Ordinance, and, in addition,l ' a major automobile agency may be located thereon. ` II I C. That the uses permitted in the multiple family district as delineated on "Exhibit D" shall be those permitted in the "R-4" Multi - Family District of said Zoning Ordinance. D. That the uses permitted in the single family district shall be those uses permitted in the "R-3" Single -Family District of said Zoning Ordinance, and lot sizes shall conform substantially with those delineated on "Exhibit D". 'I i E. Street classifications are specifically excluded from this Ordinance and are to be determined at a later date. I� F. G. That all utility improvements within the boundary of the development shall be underground installations, and sewer installations shall be in the center of streets. H. That the content and delineation of "Exhibit B" and "Exhibit G", as attached hereto and made a part hereof by this reference, shall be binding as to the conditions under which the development shall be accom- 1'I plished, SECTION 6: That such reclassification is made pursuant to the affirmative recommendation of the Zoning Board of Appeals of the City of I' McHenry voting upon the application, following proper publication of is notice, public hearing, and pre -hearing conferences, all in accordance I with the provisions of the Zoning Ordinance of the City of McHenry. SECTION 7: That all ordinances, or parts thereof, in conflict herewith be and the same hereby are repealed. SECTION 8: That this Ordinance shall be in effect from and after its passage and approval, according to law. Passed and approved this 6th day of November, 1967.
