AMENDING THE ZONING ORDINANCE OF THE CITY OF MCHENRY, ILLINOIS
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF MCHENRY,
ILLINOIS, as follows:
SECTION 1: That the Zoning Ordinance of the City of McHenry,
Illinois, as passea, approved and subsequently amended, and the
zoning map of the City of McHenry, Illinois adopted as part of
the said Zoning Ordinance be and they are hereby amended as follows:
(a) That a variation of the "I-l" Industrial District classi-
fication is hereby granted to permit the location and construction
of new and replacement buildings not less than thirteen (13) feet
from the property lines along Crystal Lake Road and Main Street
for the property described in the schedule attached hereto.
That building placements shall be substantially as
shown in the sketch which was attached to the zoning petition in
this matter.
SECTION 2: That such variation is granted pursuant to the
affirmative recommendation of all the members of the Zoning Board
of Appeals voting upon such application following proper applica-
tion therefor, publication of notice thereof, public meeting thereon,
upon agreement of the petitioners to remove certain buildings from
the property as set forth in the recommendation of the Zoning Board
of Appeals, in accordance with the provision of said Zoning Ordi-
nance and upon a finding that:
(a) The particular physical surroundings, shapes, or topo-
graphical condition of the specific property involved
would result in a particular hardship upon the owner,
as distinguished from a mere inconvenience, if the
strict letter of the regulations were carried out;
(b) the conditions upon which the petition for a variation is
based are unique and would not be applicable, generally,
to other property within the same zoning classification;
(c) the purpose of the variation is not based exclusively
upon a desire to make more money out of the property;
(d) the alleged difficulty or hardship has not been created
by any person presently having an interest in the prop-
erty;
(e) the granting of the variation will not be materially
detrimental to the public welfare or injurious to other
property or improvements in the neighborhood in which
the property is located; and
(f) the proposed variation will not impair an adequate supply
of light and air to adjacent property, or substantially
increase the congestion in the public streets, or increase
the danger of fire, or endanger the public safety, or
substantially diminish or impair property values within
the neighborhood.
SECTION 3: That all ordinances or parts thereof in conflict
herewith be and the same are hereby repealed.
SECTION 4: That this Ordinance shall be in effect from and
after its passage and approval according to law.

in McHenry County, Illinois; ALSO
Out -Lot 9 of West McHenry, a Subdivision of part of
Section 26, Township 45 North, Range 8 East of the Third
o�- Principal Meridian, according to the Plat thereof recorded
June 14, 1859 in Book 24 of Deeds, page 23, in McHenry
County, Illinois; ALSO
The North Half of the vacated East Street, as vacated by
Ordinance dated October •5, 194Z by the City of McHenry,
in Section 26, Township 45 North, Range 8 East of the
Third Principal Meridian, in McHenry County, Illinois;
ALSO
The South Half of the West 39. 0 feet of the vacated East
Street as vacated by Ordinance dated October 5, 1942 by
the City of McHenry, in Section Z6, Township 45 North,
Range 8 East of the Third Principal Meridian, in
McHenry County, Illinois; ALSO
That part of the Southeast Quarter of the Southeast Quarter
of Section 27, Township 45 North, Range 8 East of the
Third Principal Meridian, described as follows: Commencing
at a post at the Northwest Corner of Out -Lot 7 of West---'
McHenry on the South line of Main Street and running
thence West on the South line of Main Street, 66 'feet;
thence Southwesterly 176 feet to a post which stands
132 feet West of the Section line between Sections 26
and 27; thence East 132 feet to the Section line; thence
North on the Section line 186. 5 feet to the place of
beginning; in McHenry County,- Illinois.
