ORDINANCE
VACATING A PARCEL OF PUBLIC ROAD
WHEREAS, the various parcels of ground fronting on Lots 22,
23 and 24 in A. P. Freund's Mill Stream Park Addition, Unit No. 1,
within the corporate limits of the City of McHenry, have been vaguely
identified for many years by reason of uncertainty as to the exact dis-
tance between the South lot lines of said parcels and the North right-of-
way of Elm Street, and
WHEREAS, a recent survey has been taken which has estab-
lished the North right-of-way line of Elm Street to the satisfaction of the
engineers of the Division of Highways of the State of Illinois and to the
City Council of the City of McHenry, and
WHEREAS, it is deemed in the public interest that ambiguity
in titles shall be corrected in order to afford the citizens of the munici-
pality complete freedom and right in dealing with lands within the
municipality owned by them.
NOW, THEREFORE, BE IT ORDAINED by the City Council of
the City of McHenry that the premises described as follows:
That part of Illinois State Route 120 and 31, lying South
of Lots 22 thru 24 in A. P. Freund=s Mill Stream Park
Addition Unit No. 1, in Section 26, Township 45 North,
Range 8 East of the Third Principal Meridian, described
as follows: Commencing at a point on the Southerly extension
of the West line of said Lot 22, 9. 05 feet South of the South-
west corner thereof; thence continuing South along the last
described line, 14. 45 feet to a point 44. 5 feet North of the
center line of Illinois Route 120 and 31; thence East parallel
with the center line of said highway, 166. 02 feet to a point on
the Southeasterly extension of the Easterly line of Lot 24
in said Subdivision; thence Northwesterly 24. 56 feet to the
Southeasterly corner of said Lot 24; thence West along the
South line of said Lots 24 and 23 for a distance of 87. 43 feet
to a point; thence Southwesterly forming an angle of 7
degrees 07 minutes to the left with the last described line,
for a distance of 73. 12 feet to the place of beginning, in the
City of McHenry, McHenry County, Illinois.
Also:
That part dedicated for road purposes as recorded in the
Plat of A. P. Freundis Mill Stream Park Addition Unit No.
1, in Section 26, Township 45 North, Range 8 East of the
Third Principal Meridian, described as: Commencing at

the Southwest corner of Lot 22; thence East along the
South line of Lots 22 and 23 in said Subdivision, for a
distance of 72. 57 feet; thence Southwesterly forming an
included angle of 7 degrees 07 minutes to the left for a
distance of 73. 12 feet to a point on the Southerly extension
of the West line of said Lot 22, 9. 05 feet South of the place
of beginning; thence North 9. 05 feet to the place of beginning,
in the City of McHenry, McHenry County, Illinois.
be and hereby are declared to be vacated and all right, title and interest
therein shall inure to the benefit of property owners abutting said above -
described parcels to the North.
This Ordinance shall be in full force and effect from and after
its passage and approval as by statute provided.
