AN ORDINANCE
AMENDING THE ZONING ORDINANCE OF THE CITY OF MCHENRY. ILLINOIS
BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF
McHENRY, ILLINOIS AS FOLLOWS:
SECTION 1: That the Zoning Ordinance of the City of McHenry,
Illinois heretofore adopted on March 12, 1962, and the Zoning Map
adopted as a part thereof, and as said Zoning Ordinance and as said
Zoning Map have been subsequently amended, be and they are hereby
amended as follows:
A. That the property described in Exhibit 1 hereto attached and
made a part hereof be and the same is hereby classified as a Planned
Unit Development under the provisions of Article XV entitled "Special
Uses", Paragraph E entitled "Planned Unit Development."

SECTION 2: That such special use is authorized upon the finding
A. The special use will not cause substantial injury to the
value of other property in the neighborhood in which it is located;
B. The location and size of the special use, the nature and
itensity of the operation involved in or conducted in connection with
it, the size of the site in relation to it, and the location of the
site with respect to streets giving access to it, shall be such that
it will be in harmony with the appropriate and ordinary development
of the district in which it is located;
C. The location, nature and height of buildings, walls and
fences and the nature and extent of the landscaping on the site shall
be such that the use will not hinder or discourage the appropriate
development and use of the adjacent land and buildings, or will not
mpair the value thereof;
D. Parking areas shall be of adequate size for the particular
use, properly located, and suitably screened from adjoining residen-
tial uses, and the entrance and exit drives shall be laid out so as to
prevent traffic hazards and nuisances;
E. The uses permitted by any exceptions are necessary and de-
sirable and appropriate to the purpose of the development;
F. The uses permitted in the development are not of such nature
or so located as to exercise a detrimental influence or effect upon
the surrounding neighborhood;
G. That no industrial areas will be established in the Planned
Unit Development;
H. That all minimum requirements pertaining to commercial, resi-
dential, institutional or other uses established in the Planned Unit
Development will be subject to the requirements for each individual
classification as established elsewhere in this Ordinance, except as
may be specifically varied hereinafter.
SECTION 3: That the use of areas be and they are hereby estab-
lished as follows: Commercial, Multiple Family Residential, Single-
'amily Residential, Public Park, Public Open Space, School, Church,
and Golf Course; and that the use areas be and they are hereby estab-
lished as shown upon the Use Area Map hereto attached and made a part
hereof as Exhibit 2.
SECTION 4: That said Planned Unit Development area may be de-
veloped in stages or phases according to the Phase Development Map
(projected) hereto attached and made a part hereof as Exhibit 3.

SECTION 5: That said Planned Unit Development is authorized as
a special use upon the following conditions:
A. That all public open space and public park area be dedicated
to the City of McHenry, Illinois by plat, provided that the physical
condition, contour and outline thereof be specified upon submission
of a final phase plat for final approval, and that such physical
condition, contour and outline thereof be approved by and acceptable
to the City of McHenry, and provided further that the completion of
,ny proposed physical change be assured by performance bond.
B. That the uses permitted in the commercial area located in
phase 1 on the Phase Development Map shall be those uses permitted in
the "B-3" Commercial District of said Zoning Ordinance.
C. That the commercial uses permitted in the major commercial
area shown as phase 4 on said phase Development Map shall be all those
uses permitted in the "B-1" Commercial Retail District of said Zoning
ordinance, and in addition thereto one automobile service station and
one motel.
D. That the uses permitted in the Multiple Family District shall
.ae those uses permitted in the "R-4" Multi -Family District of said
Zoning Ordinance.
E. That the uses permitted in the Single -Family District shall
be those uses permitted in the "R-3" Single -Family District of said
Zoning Ordinance, provided, however, that the minimum lot sizes may
be 7,500 square feet in area, provided that the formula contained in
said Article XV, Paragraph E-6 is observed, and provided further that
restrictions and covenants relating to such single-family residential
use be recorded, as contained in Exhibit 4 hereto attached and made
part hereof.

F. Street classifications and locations are hereby established
as shown on the Street Map attached hereto as Exhibit 5.
G. Adjustments shall be authorized by the City Council of the
City of McHenry, Illinois for placement or replacement of streets, lots,
public open spaces, public park spaces and the like if a peripheral road
is authorized by the City of McHenry, Illinois to be located upon or
through any portion of the Planned Unit Development area.
SECTION 6: That such reclassification is made pursuant to the
affirmative recommendation of all members of said Zoning Board of
Appeals voting upon such application, following proper application
therefor, publication of notice thereof, and public hearing, in accord-
.nce with the provisions of said Zoning Ordinance.
SECTION 7: That all ordinances or parts thereof in conflict
herewith be and the same are hereby repealed.
SECTION 8: That this Ordinance shall be in effect from and
after its passage and approval according to law.
