ORDINANCE
WHEREAS, a zoning hearing has been held before the City of
McHenry Zoning Board of Appeals on the 18th day of January, 1963,
for the purpose of considering the application of Thomas L. Lagios and
Virginia M. Lagios, his wife, for a zoning variation in regard to
certain property as described in the said petition for hearing, and
WHEREAS, as a result of said hearing, the Zoning Board of
Appeals recommends that the City Council of the City of McHenry,
should it see fit to grant the prayer for variation, place certain
restrictions upon the premises, as are set forth fully in the recommen-
dation of the said Board as considered by the City Council of the City
of McHenry at its regular meeting of February 4, 1963.
NOW, THEREFORE, be it ordained that the Zoning
Ordinance of the City of McHenry, Illinois, be and
hereby is amended as to:
Part of the Southeast Quarter of Section 27, Township
45 North, Range 8 East of the Third Principal Meridian,
lying West ofHanleyts First Addition to West McHenry,
bounded and described as follows: Beginning at a point
132 feet North, 74 degrees, 17 minutes West of an
iron stake at the most Westerly beginning; thence
North _74 degrees, 17 minutes West, 66 feet; thence
North 15 degrees, 43 minutes East to the center of
the highway known as the Woodstock Road; thence
Southeasterly along the center line of said Highway
to a point which is North 15 degrees, 43 minutes East,
198. 8 feet from the place of beginning; thence South
15 degrees, 43 minutes West to the place of beginning,
in the following manner: Petitioners, and Petitioners
only, shall be permitted to utilize the premises above
described for the operation of a pet shop, but such
use shall be restricted as follows: For a period of 3 years and
1. Petitioners shall provide the Enforcing Officer,
within a reasonable time, with a floor plan of
the residence area intended for pet shop use.
The shop operation shall not be permitted to
be extended beyond the area depicted in such
floor plan.
2. The operation of the pet shop shall be restricted
to the Petitioners only, and if they shall move
from the premises during the aforesaid three-
year period, the right to the variation usage
shall terminate.
3. Petitioners shall provide adequate off-street
parking as is required for such business usage
under the existing ordinance.

4. No kennel operation shall be permitted which
shall result in the housing of cats, dogs, or
other animals.
5. Personal pets of the Petitioners shall be under
the same restriction as shall apply under the
residential zoning requirements.
This Ordinance shall be in full force and effect from and after its
passage and approval as by statute provided.
