ORDINANCE AMENDING ZONING
ORDINANCE OF THE CITY
OF McHENIRY . ILLINOIS
W-HEREAS, a public hearing was held before the Zoning Board
of Appeals of the City of McHenry, Illinois, which Board was acting
as a soecial commission for the purpose of hearing the petition and
facts concerning the said amendment; and
WHEREAS, the said Zoning Board of Appeals, acting as a
special commission has recommended to the City Council of the City of
McHenry that the petition concerning property described as follows:
That part of Out Lot 13 bounded and described as
follows, to -wit: Commencing at the South East
corner of block 10, of the Original Plat of the
Village of West McHenry, thence North 7b;. degrees
West h.70 chains and to the South West corner of
said Block 10, thence South a distance of 68.561
feet to the South line of James Street and the
West line of Out Lot 13 for a place of beginning:
thence bouth a distance of 396.93 feet to the South
West Corner of Out Lot 13, thence East along the
South line of Out Lot 13 to the intersection of the
West line of Fourth Street extended South westerly
thence North Easterly along the West line of Fourth
Street extended South Westerly to the intersection
of the South line of James Street, thence North U
degrees, 29 minutes West along the Southerly line of
James Street to the place of beginning, said des-
cription intending to describe that portion of Out
Lot 13 lying West of the West line of rourth Street
extended South Westerly and lying South of the South
line of James Street, in the City of McHenry and
County of McHenry in the State of Illinois.
said property being owned by Robert E. Stoller and Irene D. Stoller
of McHenry, Illinois, be granted under certain terms and conditions as
recommended by the Board,
NOW, THEREFORE, BE IT ORDAINED by the City Council of
the City of McHenry that the zoning classification of
t}le above described property be and hereby is varied
to permit the construction thereon of a multiple dwelling
unit in conformity with the following: That the zoning
requirements covering the property described above be
varied to permit the construction of a multiple dwelling
unit not to exceed two stories in heighth and to contain
not more than sixteen dwelling units, with any of such use
of the property to be in conformity with the set -back
regulations of the R-1 classification as set forth in the
Zoning Ordinance of the City of rlcheru•y, and with the

further stipulation that the utilization of ground
area also comply with the restrictions as set forth
under the R-1 classification, all of the said property
concerned to be retained as one parcel, and with the
further provision that no separation into separate
parcels shall ever be made for any utilization other
than that herein recommended.
This amendmnt shall be in full force and effect from and
after the date of its passage.
