AN ORDINANCE FOR THE LEVY OF TAXES
FOR THE CURRENT FISCAL YW
thereas the City Council of the City of McHenry, in the County of
McHenry and State of Illinois, did on the 3rd day of July, A. D. 1939, pass
the Annual Appropriation Bill for said City for the fiscal year beginning
May let, 1939, the amount of which is ascertained to be the aggregate sum of
Thirty-eight Thousand Five Hundred Forty-six ($38,546.00) Dollars, which said
Appropriation Bill was duly published on the day of July, A. D. 1939,
now therefore,
19E IT ORDAINED by the City Council of the City of McHenry, McHenry
County, Illinois, that there be and is hereby levied upon all taxable property
within the corporate limits of said City for the year 1939, the total sum of
Thirteen Thousand One Hundred Thirty-six ($13,136.00) Dollars for the following
specific purposes mentioned in said Appropriation Bill and in the respective
sums as follows, to -wit:

Dear Vernon:
Among the tax objections which are now being heard
by the County Court is an item for the City of McHenry amount-
ing to $152.11. From the face of the tax levy as filed with (�I
the County Clerk, it appears that your annual appropriation i I 1
ordinance was passed July 3, 1939 and was published on July 13,
1939• It appears further that your tax levy ordinance was
\ ss� n July 5. 1939, which was prior to the publication
of your appropriation, and of course, the objection is based
upon the fact that the appropriation ordinance was not effect-
ive until after its publication according to law, and therefore,
there was nothing upon which to base a tax levy ordinance on
July's. 1939•
I write you at this time to ascertain whether it is
possible that the Clerk made an error in the tax levy ordinance
as to the date of the passage of the levy. Of course, his
records will indicate this but it occurred to me. as you only
have one meeting a month that possibly the levy was passed on
August 5. 1939, instead of July. as he certifies in his ordin-
euice.
Would you please advise me on this as soon as you have
had an opportunity to check it, and in any event, I would like
to know by Monday, April 14th. If the tax levy ordinance was
actually passed on August 5, 1939. and so shows in the Clerk's
mtndtes, I would like to have the Clerk appear on Monday with
his Minute Book. r___1
