HomeMy WebLinkAboutOrdinances - MC-996-648 - 02/07/1996 - Retained Personnel DepositORDINANCE NO: MC-99-750 AN ORDINANCE ADOPTING THE INTERNATIONAL PROPERTY MAINTENANCE CODE WHEREAS, the City of McHenry desires to: Establish minimum regulations governing the conditions and maintenance of all property, buildings and structures: Provide minimum standards for supplied utilities and facilities, and other physical things and conditions essential to ensure that structures are safe, sanitary and fit for occupation and use; and Establish corrective measures and procedures for buildings and structures unfit for human occupancy and use. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL of the CITY OF MCHENRY, McHenry County, Illinois as follows: SECTION 1: That a certain document, three (3) copies of which are on file with the office of the City Clerk of the City of McHenry, being marked and designated as the "The International Property Maintenance Code, First Edition, 1998," as published by the Building Officials and Code Administrators International, Inc., the International Conference of Building Officials, and the Southern Building Code Congress International, Inc., be and hereby is adopted as the Property Maintenance Code of the City of McHenry, Illinois; for the control of buildings and structures as herein provided; and each and all of the regulations, provisions, penalties, conditions, and terms of said Property Maintenance Code are hereby referred to, adopted, and made a part hereof, as if fully set out in this ordinance with 1 the additions, insertions, deletions and changes prescribed in Section 2 of this ordinance. SECTION 2: That the following sections of said International Property Maintenance Code, First Edition, 1998, are hereby revised: Section 101.1 Insert: "the City of McHenry". Section 103. Delete all. Retitle "Enforcement." Insert: "Section 103.1. General. It shall be the duty and responsibility of the Building Officer to enforce the provisions of the Property Maintenance Code. The Building Officer is hereby referred to as the code official. Section 106.2. Delete: "in accordance with Section 107" in line 2. Section 107.1. Delete: "in the manner prescribed in Sections 107.2 and 107.3." from line 5. Delete: "108.3." from line 7. Insert: 7-94 of the Municipal Code." Section 107.2. Delete. Section 107.3. Delete. Section 108.3. Delete: "107.3." from line 6. Insert: "7-94 of the Municipal Code." Delete last sentence of paragraph. Section 111. Delete all. Insert: "Any person aggrieved by any decision of the code official may appeal therefrom to the City Council which may affirm, modify, or reverse the decisions of the code official. Thereupon, the code official shall take action in accordance with the decisions of the City Council. Section 302.4. Delete: "10 inches" and insert, "eight (8) inches". Section 302.7.1. Delete: "building code" from second line. Insert: "Section 22-20 of the Municipal Code." Section 302.8. Delete: "Except as provided for in other regulations, not more than one currently unregistered or uninspected motor vehicle shall be parked, kept, or stored on any premises, and." Section 303.3. Delete. Insert: "Street number shall be displayed in accordance with Section 21-20 of the Municipal Code." 2 Section 303.15. Insert: "April 1st to November 15th." Section 506.1. Insert: " Cross connection of sanitary and storm sewers shall not be permitted. Section 602.3. Delete lines 5 thru 7 and replace with: "heat during the period from September 15th to June 1st to maintain a temperature of not less than 680 F during the period between 6:30 A.M. and 10:30 P.M., and 650 F at all other times, in all habitable rooms, bathrooms, and toilet rooms." Section 602.4. Insert: "September 15th to June 1st." Section 705.5. Delete. Insert: "Smoke detectors shall be installed in accordance with Section 7-20 of the Municipal Code." Chapter 8. Delete references to IMC-98, IPC-98, IZC-.98. Insert reference to IMC 96. SECTION 3: That the table included in paragraph A, entitled "Payments," of Section 1-12, entitled "Settlement of Offenses," of the Municipal Code shall be and hereby is amended to include the following language at the end of said table: SECTION OFFENSE COLUMN A COLUMN B Property Maintenance Code All Various 25.00 50.00 SECTION 4: If any section, paragraph, subdivision, clause, sentence, or provision of this ordinance shall be adjudged by any court of competent jurisdiction to be invalid, such judgement shall not affect, impair, invalidate or nullify the remainder thereof, which remainder shall remain and continue in full force and effect. 3 SECTION 5: In the event of a conflict between the requirements of this ordinance and any other code, ordinance or restriction of the City of McHenry, the more stringent requirement shall prevail. SECTION 6: This ordinance shall be in full force and effect upon its passage, approval, and publication in pamphlet form (which publication is hereby authorized) as provided by law.
