AN ORDINANCE AMENDING
CHAPTER 4 OF THE MCHENRY MUNICIPAL CODE
IN REGARDS TO LIQUOR LICENSE CLASSIFICATIONS
WHEREAS, the City Council of the City of McHenry, Illinois, has established
license classifications and fees for persons and premises that sell alcoholic
beverages at retail and has, from time to time, amended these license
classifications and fees.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL of the
CITY OF MCHENRY, McHenry County, Illinois as follows:
SECTION 1: That paragraph (4) of Section 4-6, entitled, "License
classification and fees; limitation on number of licenses," of Chapter 4, entitled,
"Alcoholic Beverages," of the McHenry Municipal Code shall be, and it hereby is
amended and shall hereinafter be and read as follows:
(4) Class F(1) license, which shall authorize the sale at retail of alcoholic
liquors in packages only, for consumption off the premises, where
more than 50% of the public sales area of said premises is devoted to
alcoholic liquor. The annual fee for such license shall be one
thousand one hundred dollars ($1,100). No more than two (2) such
Class F(1) licenses shall be in force in the City at any time.
Class F(2) license, which shall authorize the sale at retail of alcoholic
liquors in packages only, for consumption off the premises, where
50% or less of the public sales area for said premises is devoted to
goods and commodities other than alcoholic liquor. The annual fee for
such license shall be eight hundred dollars ($800). No more than six
(6) such Class F(2) licenses shall be in force in the City at any time.

SECTION 2: If any section, paragraph, subdivision, clause, sentence, or
provision of this ordinance shall be adjudged by any court of competent jurisdiction
to be invalid, such judgement shall not affect, impair, invalidate or nullify the
remainder thereof, which remainder shall remain and continue in full force and
effect.
SECTION 3: All ordinances or parts of ordinances in conflict herewith are
hereby repealed to the extent of such conflict.
SECTION 4: This ordinance shall be in full force and effect upon its
passage, approval, and publication in pamphlet form (which publication is hereby
authorized) as provided by law.
