MC-99-747 AN ORDINANCE AMENDING THE SUBDIVISION CONTROL ORDINANCE OF THE CITY OF MCHENRY WITH RESPECT TO CASH CONTRIBUTIONS FOR PARK LAND WHEREAS, the City of McHenry has found that providing safe and useable parks and open space enhances the quality of life for its residents as well as for non- residents using such facilities; and WHEREAS, the dedication of park land or a cash contribution in lieu thereof is a requirement for new residential subdivisions and for dwelling units proposed to be constructed in the City where no cash contribution has previously been paid to ensure that adequate recreation activities and services are available to serve the immediate and future needs of residents generated by new dwelling units, and WHEREAS, the cash contribution in lieu of land donation is based on the fair market value of land in the area improved within the planning jurisdiction of the City; and WHEREAS, the fair market value of such improved land was last reviewed by the City in 1991 and determined to be $30,000 per acre; and WHEREAS, a recent study conducted by a licensed land appraiser has concluded that the fair market value of such improved land in the City is currently $113,000 per acre; and WHEREAS, the Table of Estimated Ultimate Population Per Dwelling Unit, published by the Illinois School Consulting Service in 1996 is generally indicative of the current and short range projected trends of the number persons generated by new development. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL of the CITY OF MCHENRY, McHenry County, Illinois as follows: 1 SECTION 1: That Paragraph c., entitled, "Density Formula," of Subsection 1 entitled, "Criteria for Requiring Park and Recreation Land Dedication:," of Paragraph H, of Section V of the Subdivision Control Ordinance of the City of McHenry, shall be, and it hereby is amended to change the date referenced in line 3 of said paragraph for the Table of Estimated Ultimate Population Per Dwelling Unit, published by the Illinois School Consulting Service, from 1989 to 1996. SECTION 2: That Paragraph c., entitled, "Density Formula," of Subsection 2 entitled, "Criteria for Requiring School Site Dedication:," of Paragraph H, of Section V of the Subdivision Control Ordinance of the City of McHenry, shall be, and it hereby is amended to change the date referenced in line 3 of said paragraph for the Table of Estimated Ultimate Population Per Dwelling Unit, published by the Illinois School Consulting Service, from 1989 to 1996. SECTION 3: That Subsection 3 entitled, "Criteria for Requiring a Contribution in Lieu of Park and School Sites; Fair Market Value," of Paragraph H, of Section V of the Subdivision Control Ordinance of the City of McHenry, shall be, and it hereby is amended to change the amount of the fair market value of improved land in the planning jurisdiction of the City from $30,000 per acre to $100,000 per acre. SECTION 4: That the table entitled, "Contribution Per Residential Dwelling Unit For:," within Subsection 4, of Paragraph H, of Section V, and within Appendix A-8, of the Subdivision Control Ordinance of the City of McHenry, shall be, and it hereby is amended to hereinafter be and read as follows: CONTRIBUTION PER RESIDENTIAL DWELLING UNIT FOR: TYPE OF RESIDENTIAL DWELLING UNIT Single Family Dwellings: 2 bedroom or less 3 bedroom 4 bedroom 5 bedroom or more TOTAL CONTRUBUTION SCHOOLS PARK LIBRARY FIRE DIST. SECTION 7: That Appendix A-10, 1989 Table of Estimated Ultimate Population Per Dwelling Unit, of the Subdivision Control Ordinance of the City of McHenry, shall be, and it hereby is deleted, and shall be replaced with the 1996 Table of Estimated Ultimate Population Per Dwelling Unit attached hereto and by this reference incorporated herein as Exhibit A. SECTION 8: If any section, paragraph, subdivision, clause, sentence, or provision of this ordinance shall be adjudged by any court of competent jurisdiction to be invalid, such judgement shall not affect, impair, invalidate or nullify the remainder thereof, which remainder shall remain and continue in full force and effect. SECTION 9: All ordinances or parts of ordinances, in conflict herewith are hereby repealed to the extent of such conflict. K SECTION 10: This ordinance shall be in full force and effect ninety (90) days after its passage, approval, and publication in pamphlet form (which publication is hereby authorized) as provided by law.
