MC-99-746 AN ORDINANCE AMENDING THE MCHENRY MUNICIPAL CODE WITH RESPECT TO CASH CONTRIBUTIONS FOR PARK LAND WHEREAS, the City of McHenry has found that providing safe and useable parks and open space enhances the quality of life for its residents as well as for non- residents using such facilities; and WHEREAS, the dedication of park land or a cash contribution in lieu thereof is a requirement for new residential subdivisions and for dwelling units proposed to be constructed in the City where no cash contribution has previously been paid to ensure that adequate recreation activities and services are available to serve the immediate and future needs of residents generated by new dwelling units; and WHEREAS, the cash contribution in lieu of land donation is based on the fair market value of land in the area improved within the planning jurisdiction of the City; and WHEREAS, the fair market value of such improved land was last reviewed by the City in 1991 and determined to be $30,000 per acre; and WHEREAS, a recent study conducted by a licensed land appraiser has concluded that the fair market value of such improved land in the City is currently estimated at $113,000 per acre. WHEREAS, the Table of Estimated Ultimate Population Per Dwelling Unit, published by the Illinois School Consulting Service in 1996 is generally indicative of the current and short range projected trends of the number persons generated by new development. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL of the CITY OF MCHENRY, McHenry County, Illinois as follows: 1 SECTION 1: That the table entitled, "Contribution Per Residential Dwelling Unit For:" within Section 7-4, entitled, "Cash contributions for school, park, Fire Protection District and library purposes as condition for approval for residential building permit; calculation; when payable; remittance to school district," of Chapter 7 of the McHenry Municipal Code shall be, and it hereby is amended and shall hereinafter be and read as follows: CONTRIBUTION PER RESIDENTIAL DWELLING UNIT FOR: TYPE OF RESIDENTIAL TOTAL CONTRUBUTION DWELLING UNIT SCHOOLS PARK LIBRARY FIRE DIST. PER UNIT Single Family Dwellings: 2 bedroom or less $1,962.00 $3,026.00 $245.00 $245.00 $ 5,478.00 3 bedroom 3,193.00 4,349.00 $245.00 $245.00 8,032.00 4 bedroom 4,422.00 5,646.00 $245.00 $245.00 10,558.00 5 bedroom or more 4,544.00 5,655.00 $245.00 $245.00 10,689.00 Apartments: Efficiency $ -0- $1,941.00 $245.00 $245.00 $ 2,431.00 1 bedroom -0- 2,637.00 245.00 245.00 3,127.00 2 bedroom 791.00 2,871.00 245.00 245.00 4,152.00 3 bedroom or more 3,562.00 4,580.00 245.00 245.00 8,632.00 Townhouse, Row House, Quadriplex: 1 bedroom $ -0- $1,790.00 $245.00 $245.00 $ 2,080.00 2 bedroom 1,650.00 2,985.00 245.00 245.00 5,125.00 3 bedroom 1,869.00 3,588.00 245.00 245.00 5,947.00 4 bedroom 4,498.00 5,331.00 245.00 245.00 10,119.00 SECTION 2: That the annual adjustment to the cash contributions, effective for the date of May 1, 2000, only, and amounting to the previous year Annual Average percentage increase in the Chicago Area Consumer Price Index, as published by the U.S. Department of Labor, Bureau of Labor Statistics, shall not apply to the required cash contribution for parks. 2 SECTION 3: If any section, paragraph, subdivision, clause, sentence, or provision of this ordinance shall be adjudged by any court of competent jurisdiction to be invalid, such judgement shall not affect, impair, invalidate or nullify the remainder thereof, which remainder shall remain and continue in full force and effect. SECTION 4: All ordinances or parts of ordinances in conflict herewith are hereby repealed to the extent of such conflict. SECTION 5: This ordinance shall be in full force and effect ninety (90) days after its passage, approval, and publication in pamphlet form (which publication is hereby authorized) as provided by law.
