AN ORDINANCE AMENDING
THE MCHENRY MUNICIPAL CODE
WITH RESPECT TO WATER CAPITAL DEVELOPMENT FEES
WHEREAS, the City of McHenry desires to maintain a safe and adequate water
supply and distribution system for existing and future residents; and
WHEREAS, an increase in the water capital development fees charged for new
development is needed to ensure that adequate funds are available to provide a save
and adequate water supply and distribution system in the City.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL of the CITY
OF MCHENRY, McHenry County, Illinois as follows:
SECTION 1: That as of February 9, 2000, the column entitled, "Water," within
Tables (A) and (B), of Section 22-166, of Article IV, of Chapter 26 of the McHenry
Municipal Code shall be, and it hereby is amended to read as follows:
(A) For Residential Buildings/Uses
Water
Detached Single Family:
Two bedroom or less $ 1,084.00
Three bedroom $ 1,799.00
Four bedroom or more $ 2,022.00
Attached Single Family:
One bedroom $ 642.00
Two bedroom $ 1,070.00
Three bedroom $ 1,285.00

SECTION 3: That the annual adjustment to the water capital development fees,
effective for the date of May 1, 2000, only, and amounting to the previous year
Construction Cost Index, as published by the Engineering News Record, shall not
apply.
SECTION 4: If any section, paragraph, subdivision, clause, sentence, or
provision of this ordinance shall be adjudged by any court of competent jurisdiction to
be invalid, such judgement shall not affect, impair, invalidate or nullify the remainder
thereof, which remainder shall remain and continue in full force and effect.
SECTION 5: All ordinances or parts of ordinances in conflict herewith are
hereby repealed to the extent of such conflict.
SECTION 6: This ordinance shall be in full force and effect after its passage,
approval, and publication in pamphlet form (which publication is hereby authorized) as
provided by law.
