AN ORDINANCE AMENDING CHAPTER 26, WATER AND SEWERS,
OF THE MUNICIPAL CODE, CITY OF MCHENRY, ILLINOIS,
TO DETERMINE THAT THE WATERWORKS AND SANITARY SEWER
TREATMENT FACILITIES OF THE CITY OPERATES AS
A COMBINED WATERWORKS AND SEWERAGE SYSTEM
WHEREAS, the City of McHenry has separate waterworks and sanitary sewer
treatment facilities; and
WHEREAS, the Illinois Municipal Code, 65 ILCS 5/11-139-1 et seq., permits the City
of McHenry to determine that its waterworks and sanitary sewer treatment facilities operate
in combination.
NOW, THEREFORE, BE IT ORDAINED by the CITY COUNCIL of the CITY OF
MCHENRY, McHenry County, Illinois, as follows:
SECTION 1: That the City of McHenry hereby determines that based on past
operation of the City of McHenry's waterworks and sanitary sewer treatment facilities, the
two operate in combination.
SECTION 2: That Chapter 26, Water and Sewers, of the Municipal Code, City of
McHenry, Illinois, shall be amended to add Sec. 26-0. Combined Waterworks and
Sewerage System, which shall read as follows:
Sec. 26-0. Combined Waterworks and Sewerage System
Pursuant to 65 ILCS 5/139-1 et seq., the City's waterworks and sanitary sewerage
treatment facilities are a combined waterworks and sewerage system.
SECTION 3: If any section, paragraph, subdivision, clause, sentence or provision
of this Ordinance shall be adjudged by any Court of competent jurisdiction to be invalid,
such judgment shall not affect, impair, invalidate or nullify the remainder thereof, which
remainder shall remain and continue in full force and effect.
SECTION 4: All ordinances or parts of ordinances in conflict herewith are hereby
repealed to the extent of such conflict.
SECTION 5: This Ordinance shall be published in pamphlet form by and under the
authority of the corporate authorities of the City of McHenry, McHenry County, Illinois.
SECTION 6: This Ordinance shall be in full force and effect from and after its
passage, approval, and publication in pamphlet form as provided by law.
