HomeMy WebLinkAboutOrdinances - MC-99-728 - 05/19/1999 - zoning Ch X accessory usesORDINANCE NOMc -99- 727 An Ordinance Amending Chapter 13, Traffic and Motor Vehicles, and Chapter 16, Parks and Recreation of the City of McHenry Municipal Code, to Adopt Certain Provisions Relating to Skateboards BE IT ORDAINED by the CITY COUNCIL of the CITY OF McHENRY, McHenry County, Illinois, as follows: SECTION 1: In the Municipal Code, City of McHenry, Illinois, Chapter 13, Traffic and Motor Vehicles, the following Articles shall be renumbered as follows: Current Title New ARTICLE IX PENALTIES ARTICLE X ARTICLE X VALIDITY ARTICLE XI ARTICLE XI PRIOR ORDINANCES REPEALED ARTICLE XII ARTICLE XII PUBLICATION IN PAMPHLET FORM ARTICLE XIII ARTICLE XIII EFFECTIVE DATE ARTICLE XIV SECTION 2: In the Municipal Code, City of McHenry, Illinois, Chapter 13, Traffic and Motor Vehicles, shall be amended to include the following new Article IX: ARTICLE IX, Miscellaneous 13-901 SKATEBOARDS.* (A) No person shall ride a skateboard upon any sidewalk or highway located within any commercial zoning district within the City. (B) The Superintendent of Public Works is authorized to have signs erected in such commercial zoning districts prohibiting the riding of skateboards therein. (C) No person shall ride or operate a skateboard within any City park or bike path, except at such places as may be designated by the Director of Parks and then only in accordance with the rules, regulations and restrictions promulgated and posted. * Cross Reference — Skateboards, Sec 16-49. SECTION 3: In the Municipal Code, City of McHenry, Illinois, Chapter 16, Parks and Recreation, shall be amended to include the following new Section 16.49: 1 Sec. 16.49. Skateboards.* No person shall ride or operate a skateboard within any City park or bike path, except at such places as may be designated by the Director of Parks and then only in accordance with the rules, regulations and restrictions promulgated and posted. SECTION 4: If any section, paragraph, subdivision, clause, sentence, or provision of this ordinance shall be adjudged by any court of competent jurisdiction to be invalid, such judgement shall not affect, impair, invalidate or nullify the remainder thereof, which remainder shall remain and continue in full force and effect. SECTION 5: All ordinances or parts of ordinances in conflict herewith are hereby repealed to the extent of such conflict. SECTION 6: This ordinance shall be in full force and effect upon its passage, approval, and publication in pamphlet form (which publication is hereby authorized) as provided by law.
