AN ORDINANCE AMENDING THE TEXT OF THE ZONING ORDINANCE
OF THE CITY OF MCHENRY- BY ADDING "MINI -WAREHOUSE" TO TABLE 9,
GROUP U, CONDITIONAL USES IN THE 1-1, INDUSTRIAL DISTRICT.
WHEREAS, a petition has been filed with the City Clerk of the City of
McHenry, McHenry County, Illinois requesting an amendment to the text of the
Zoning Ordinance; and,
WHEREAS, the proposed amendment would add "Mini -Warehouse" to
Table 9, Group U, Conditional Uses in the 1-1, Industrial District„ together with a
definition of this use; and
WHEREAS, pursuant to proper legal notice, the City of McHenry Zoning
Board of Appeals has held a public hearing to take evidence and view exhibits
regarding this amendment; and,
WHEREAS, based on evidence heard, the Zoning Board of Appeals has
submitted its findings to the corporate authorities and has recommended approval
of this amendment.
NOW, THEREFORE, BE IT ORDAINED BY CITY COUNCIL OF THE
CITY OF MCHENRY, MCHENRY COUNTY, ILLINOIS, as follows:
SECTION 1: That Table 9, Group U, of the Zoning Ordinance of the City
of McHenry shall be amended by adding "Mini -Warehouse" to the list of
Conditional Uses.
SECTION 2: That Chapter XIX, Definitions, of the Zoning Ordinance of the
City of McHenry shall be amended by inserting the following into the list of
Definitions:
MINI -WAREHOUSE: A building or group of buildings in a controlled
access area that contain varying sizes of
individual, compartmentalized and controlled
access stalls or lockers for the storage of
customer's non -hazardous goods or wares.
SECTION 3: The City Council finds that this amendment to the text of the
Zoning Ordinance of the City of McHenry promotes the public interest.
SECTION 4: If any section, paragraph, subdivision, clause, sentence or
provision of this Ordinance shall be adjudged by any Court of competent
jurisdiction to be invalid, such judgment shall not affect, impair, invalidate or nullify
the remainder thereof, which remainder shall remain and continue in full force and
effect.
SECTION 5: All Ordinances, or parts of thereof, in conflict with the terms
and conditions hereof are hereby repealed to the extent of such conflict.
SECTION 6: This Ordinance shall be published in pamphlet form by and
under the authority of the corporate authorities of the City of McHenry, McHenry
County, Illinois.
SECTION 7: This Ordinance shall be in full force and effect from and after
its passage, approval, and publication in pamphlet form as provided by law.
