BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF MCHENRY, McHENRY
COUNTY, ILLINOIS, as follows:
SECTION 1. Section 26-166 of the Municipal Code, City of McHenry,
Illinois relating to the Water and Sewer Capital Development Fee Schedule
is hereby amended to read as follows effective January 1, 1998:
"Effective January 1, 1998, Section 26-166 relating to Water and Sewer
Capital Development Fee Schedule for residential and non-residential
buildings shall be amended to read as follows:
A. Residential Building Uses *:

* Capital Development Fees shall be increased May 1, 1999 and each May
1st thereafter by the percentage increase in the Engineering News
Record Construction Cost Index and shall be subject to annual Council
review."
SECTION 2. Any person, firm or corporation violating any provision
of this ordinance shall be fined not less than Twenty Five Dollars
($25.00) nor more than Seven Hundred Fifty Dollars ($750.00) for each
offense committed on each day during, or on which, a violation occurs or
continues.
SECTION 4. All ordinances, or parts thereof, in conflict with the
terms and provisions hereof, be and the same are hereby repealed to the
extent of such conflict.
SECTION 5. This ordinance shall be published in pamphlet form by and
under the authority of the corporate authorities of the City of McHenry,
Illinois.
SECTION 6. This ordinance shall be in full force and effect from and
after its passage, approval and publication, as provided by law.
