AN ORDINANCE AMENDING THE ZONING ORDINANCE OF
THE CITY OF McHENRY TO ADD "RESTAURANT SERVING
ALCOHOLIC BEVERAGES WITH LIVE ENTERTAINMENT OR
DANCING" TO TABLE 9, GROUP W, CONDITIONAL USES
IN A BUSINESS PARR DISTRICT OF THE CITY OF
McHENRY, McHENRY COUNTY, ILLINOIS.
WHEREAS, a petition has been filed with the City Clerk of
the City of McHenry for a Conditional Use Permit and for an
Amendment to Table 9, Group W, Conditional Uses in a Business
Park District to add "Restaurant Serving Alcoholic Beverages
with Live Entertainment or Dancing;" and,
WHEREAS, the proposed amendment would add "Restaurant
Serving Alcoholic Beverages with Live Entertainment or Dancing"
to Table 9, Group W, Conditional Uses in a Business Park District;
and,
WHEREAS, pursuant to proper, legal notice, the City of McHenry
Zoning Board of Appeals has held public hearings on October 6, 1997
and October 27, 1997 to take evidence and view exhibits regarding
the amendment; and
WHEREAS, based on the evidence heard, the Zoning Board of
Appeals has submitted its findings to the corporate authorities,
and has recommended approval of this amendment.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF McHENRY, McHENRY COUNTY, ILLINOIS, AS FOLLOWS:
SECTION 1: That Table 9, Group W of the Zoning Ordinance of
the City of McHenry, as amended, shall be amended by adding the
words "Restaurant Serving Alcoholic Beverages with Live Entertain-
ment or Dancing," and "Restaurant Serving Alcoholic Beverages
Without Live Entertainment or Dancing."
SECTION 2: The City Council finds these amendments to Table
9, Group W of the Zoning Ordinance of the City of McHenry promote
the public interest.
SECTION 3: If any section, paragraph, subdivision, clause,
sentence or provision of this Ordinance shall be adjudged by any
Court of competent jurisdiction to be invalid, such judgment shall
not affect, impair, invalidate or nullify the remainder thereof,
which remainder shall remain and continue in full force and effect.
SECTION 4: All Ordinances, or parts of thereof, in conflict
with the terms and provisions hereof are hereby repealed to the
extent of such conflict.
SECTION 5: This Ordinance shall be published in pamphlet
form by and under the authority of the corporate authorities of
the City of McHenry, McHenry County, Illinois.
SECTION 6: This Ordinance shall be in full force and effect
from and after its passage, approval and publication in pamphlet
form as provided by law.
