AN ORDINANCE AMENDING CHAPTER IX, SIGNS,
OF THE ZONING ORDINANCE OF THE CITY OF MCHENRY,
MCHENRY COUNTY, ILLINOIS
WHEREAS, a petition has been filed with the office of the City Clerk of the
City of McHenry, McHenry County, Illinois requesting an amendment to Chapter
IX, Signs, of the Zoning Ordinance; and,
WHEREAS, pursuant to proper legal notice, the City of McHenry Zoning
Board of Appeals has held a public hearing to take evidence and view exhibits
regarding this amendment; and,
WHEREAS, based on the evidence heard, the Zoning Board of Appeals
has submitted its findings to the corporate authorities and has recommended
approval of this amendment.
NOW, THEREFORE, BE IT ORDAINED BY CITY COUNCIL OF THE
CITY OF MCHENRY, MCHENRY COUNTY, ILLINOIS, as follows:
SECTION 1: That Chapter IX, Signs, of the Zoning Ordinance of the City
of McHenry, shall be amended by replacing Table 18: Standards for Non -Exempt
aLqM in its entirety with a revised Table 18, hereby appended to and made a part
of this Ordinance as Exhibit A.
SECTION 2: That Chapter XIX, Definitions, of the Zoning Ordinance of the
City of McHenry, shall be amended by replacing or adding the following
definitions, in alphabetical order:
Portable Signs: Any sign that is mounted on the ground,
including trailer signs, gas filled figures, and
sandwich and curb type signs, that is movable
and not permanently attached to the ground.
Temporary Signs: Any sign that is securely attached to a building
facade, including banners, pennants, and flags,
that is not permanently attached to the building.
SECTION 3: The City Council finds that these amendments to the Zoning
Ordinance of the City of McHenry promote the public interest.
SECTION 4: If any section, paragraph, subdivision, clause, sentence or
provision of this Ordinance shall be adjudged by any Court of competent
jurisdiction to be invalid, such judgment shall not affect, impair, invalidate or nullify
the remainder thereof, which remainder shall remain and continue in full force and
effect.
SECTION 5: All Ordinances, or parts of thereof, in conflict with the terms
and conditions hereof are hereby repealed to the extent of such conflict.
SECTION 6: This Ordinance shall be published in pamphlet form by and
under the authority of the corporate authorities of the City of McHenry, McHenry
County, Illinois.
SECTION 7: This Ordinance shall be in full force and effect from and after
its passage, approval and publication in pamphlet form as provided by law.

EXHIBIT A
[2] Real Estate Sian: Shall be removed within 7 days of consummation of sale or rental of property.
[3] Construction Sion: Shall be removed within 14 days of issuance of a certificate of occupancy.
[4] Outdoor Advertising Sian: Shall only be allowed as a Conditional Use in the C-5 and 1-1 zoning districts, shall
only be allowed as a principal use, shall conform to all required building setbacks, and shall be located a
minimum 100 feet from any other Outdoor Advertising Sign or from a residential zoning district.
(5] Residential Development Entrance Sign: Shall be non -illuminated, and contain only the name of the
development.
[6] Institutional Special Event Sign: Shall only be displayed on property controlled by the institution, and for a
maximum of 15 day before and 3 days after the event.
[7] Wall Sion: 1.5 square feet cumulative area for all wall, canopy, under canopy and non-exempt permanent
window signs per foot of tenant or building frontage.
[8] Shopping Center Development Entrance Sion: Shopping centers with frontage on two streets may substitute one
sign per street frontage; each sign shall be a maximum of 8 feet in height, 100 square feet in area, and set back
a minimum of 7 feet from the property line.
[9] Free Standing - Commercial Uses - Main Sign: 0.5 square feet per foot of lot frontage up to 200 feet, plus 0.75
square feet per foot of lot frontage over 200 feet, up to a maximum sign area of 200 square feet, with a minimum
setback of 5 feet; or for the C-4 zoning district, 1.5 square feet per foot of lot frontage, up to a maximum sign area
of 32 square feet, with no minimum setback required.
[10] Free Standing - Office, Industrial. and Business Park Uses - Main Sign: 0.5 square feet per foot of lot frontage;
shall be only directory type sign.
[11] Canopy Sign: Shall be considered as a wall sign when determining the maximum permitted number and area of
wall signs for commercial uses. Shall have a minimum vertical clearance of 8 feet, with a maximum sign area of
213 of the face of the canopy on which sign is placed.
(12] Under Canopy Sion: Shall have a minimum vertical clearance of 8 feet, shall not project more than 1.5 feet below
the canopy, and shall have a maximum width of 75 percent of the horizontal canopy projection.
[13] Menu Board Sion: Shall be free standing or wall signs located in side or rear yards only.
(14] Projecting Sign: Permitted in the C-4 Downtown Commercial District only. May project over public right-of-way
but shall not project more than 3 feet from building facade or above the roofline. The sign shall have a minimum
vertical clearance of 8 feet.
[15] Portable Sign: May be displayed for a maximum of 45 days, starting 180 days after expiration of any permit for a
portable sign on the same lot. Placement is subject to the approval of the Zoning Administrator to avoid traffic
hazards or other safety problems. The maximum size and placement of inflatable type displays and other
irregular signs are subject to the design and safety standards contained in this ordinance.
[16] Temporary Sign: May be permitted on a maximum of 8 occasions, with a maximum display period of 30 days for
any single occasion, and for a maximum cumulative total of 60 days of display per calendar year.
