AN ORDINANCE AMENDING CHAPTER II, FILING PROCEDURES,
PARAGRAPH C, 4, OF THE ZONING ORDINANCE
OF THE CITY OF MCHENRY, MCHENRY COUNTY, ILLINOIS
WHEREAS, a petition has been filed with the office of the City Clerk of the
City of McHenry, McHenry County, Illinois requesting an amendment to Chapter
II, Filing Procedures, Paragraph C, 4, of the Zoning Ordinance of the City of
McHenry; and,
WHEREAS, the proposed amendment would remove the requirement that
the Mayor be included in determining if there is a concurrence of a majority of all
members of the City Council when voting on a zoning request; and,
WHEREAS, pursuant to proper legal notice, the City of McHenry Zoning
Board of Appeals has held a public hearing to take evidence and view exhibits
regarding this amendment; and,
WHEREAS, based on the evidence heard, the Zoning Board of Appeals
has submitted its findings to the corporate authorities and has recommended
approval of this amendment.
NOW, THEREFORE, BE IT ORDAINED BY CITY COUNCIL OF THE
CITY OF MCHENRY, MCHENRY COUNTY, ILLINOIS, as follows:
SECTION 1: That Chapter II, Filing Procedures, Paragraph C, 4, of the
Zoning Ordinance of the City of McHenry, shall be amended by deleting the
words "In all other cases, the concurrence of a majority of all members then
holding office on the City Council, including the Mayor, shall be required." from
the second paragraph.
SECTION 2: The City Council finds that this amendment to Chapter 11,
Filing Procedures, of the Zoning Ordinance of the City of McHenry promotes the
public interest.
SECTION 3: If any section, paragraph, subdivision, clause, sentence or
provision of this Ordinance shall be adjudged by any Court of competent
jurisdiction to be invalid, such judgment shall not affect, impair, invalidate or nullify
the remainder thereof, which remainder shall remain and continue in full force and
effect.
SECTION 4: All Ordinances, or parts of thereof, in conflict with the terms
and conditions hereof are hereby repealed to the extent of such conflict.
SECTION 5: This Ordinance shall be published in pamphlet form by and
under the authority of the corporate authorities of the City of McHenry, McHenry
County, Illinois.
SECTION 6: This Ordinance shall be in full force and effect from and after
its passage, approval and publication in pamphlet form as provided by law.
