AN ORDINANCE AMENDING SECTION 14-8,
OF THE MUNICIPAL CODE OF THE CITY OF McHENRY
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF McHENRY, MCHENRY COUNTY,
ILLINOIS, as follows:
SECTION 1. That Section 14-8(f), of the Municipal Code of the City of
McHenry shall be amended to read as follows:
"Sec. 14-8(f). Construction, Alteration or Repair. No activities in
connection with construction, alteration, repair or demolition, shall be carried
on other than during the following hours:
Hours of Construction:
Weekdays Saturdays Sundays and Legal Holidays
7 am - 8 pm 8 am - 8 pm 8 am - 6 pm
Exceptions:
1. These activities may be conducted outside the specified times in the
event of emergencies in order to protect the health, safety, or
welfare of the public.
2. The hours may be extended when involving City projects when it serves
the best interest of the public good provided the affect on the
public health, comfort, convenience, peace, safety, and welfare are
minimized."
SECTION 2. That Section 14-8(1) of the Municipal Code of the City of
McHenry shall be amended to read as follows:
"Sec. 14-8(1). Machinery. For the purposes of this Section, machinery
shall be defined as any equipment that is used for the purpose of
excavating, scraping, moving, filling or leveling of earth in connection
with construction or land development.
Hours of Operation:
Weekdays Saturdays Sundays and Legal Holidays
7 am - 8 pm 8 am - 4 pm Prohibited
Exceptions:
1. The operation of machinery may be conducted outside the specified
times in the event of emergencies in order to protect the health,
safety, or welfare of the public.
2. The hours may be extended when involving City projects when it served
the best interest of the public good provided the affect on the
public health, comfort, convenience, peace, safety, and welfare are
minimized.
3. The operation of motorized garden equipment for the purpose of
preparing the soil for planting."
SECTION 3. Any person, firm or corporation violating any provision of this
ordinance shall be fined not less than Twenty Five Dollars ($25.00) nor more than
Seven Hundred Fifty Dollars ($750.00) for each offense committed on each day
during, or on which, a violation occurs or continuer.
SECTION 4. If any section, paragraph, subdivision, clause, sentence or
provision of this ordinance shall be adjudged by any Court of competent
jurisdiction to be invalid, such judgment shall not affect, impair, invalidate
or nullify the remainder thereof, which remainder shall remain and continue in
full force and effect.
SECTION 5. All ordinances or parts of ordinances in conflict herewith are
hereby repealed to the extent of such conflict.
SECTION 6. This Ordinance shall be in full force and effect upon its
passage, approval and publication in pamphlet form (which publication is hereby
authorized) as provided by law.
