An Ordinance Designating Orleans Street
and Riverside Drive as wPublic Driveways'
for Pleasure Driving only In the City of KcBenry
WHEREAS, the City Council of the City of McHenry, McHenry
County, ,Illinois, is concerned about the safety of vehicular and
pedestrian traffic in the City, and is aware that Orleans Drive and
Riverside Drive move high volumes of through traffic, causing
congestion and hazardous conditions to motorists and local
residents; and
WHEREAS, the City Council has received petitions, signed by
more than two-thirds of the property owners having frontage on
Orleans Street, to designate Orleans Street as a public driveway to
be used for pleasure driving only; and
WHEREAS, the City Council has received petitions, signed by
more than two-thirds of the property owners having frontage on
Riverside Drive, to designate Riverside Drive, north of Pearl
Street, as a public driveway to be used for pleasure driving only;
and
WHEREAS, Orleans Street and Riverside Drive experience high
volumes of traffic traveling at excessive speed, which risk the
safety of residents living in these areas and provide excessive
wear to the City streets; and
WHEREAS, the Illinois Municipal Code, 65 ILCS 5/11-97-1, et
seq., permit the Corporate Authorities of any municipality to
designate, by ordinance, the whole or any part of up to two streets
as public driveways, to be used for pleasure driving only; and
WHEREAS, said statute requires that the Corporate Authorities
be petitioned by the owners of more than two-thirds of the frontage
of land fronting upon a proposed pleasure driveway before designat-
ing public driveways to be used for pleasure driving only; and
WHEREAS, it is the desire of the Corporate Authorities to
regulate, restrain and control the speed of travel as well as
prescribe to kinds of vehicles allowed over and use of Orleans
Street and Riverside Drive by designating said city streets as
public driveways for pleasure driving only.
BE IT ORDAINED by the CITY COUNCIL of 1-he CITY OF McHENRY,
McHenry County, Illinois, as follows:
SECTION 1: Article XVI of the Motor Vehicle and Traffic
Regulations Ordinance of the City of McHenry shall provide as
f o flows :
Article XVI
Designated Public Driveways
16-001 For purposes of this Chapter 16 only, the phrase,
"Local or Secondary Residential Streets," shall not
be deemed to include Industrial Drive, Oak Drive or
McCullom Lake Road wherein this Chapter 16 regu-
lates Motor Vehicle traffic on Orleans Street.
16-002 Pursuant to 65 ILCS 5/11-97-1, et seq., Orleans
Street and Riverside Drive north of Pearl Street
are hereby designated as Public Driveways to be
used for pleasure driving only.
16-003 Motor vehicle traffic on Orleans Drive and River-
side Drive, as designated in Section 16-002, above,
shall be regulated as follows:
(a) Orleans Street.
1. Motor Vehicle 'traffic on Orleans
Street shall be limited to First Division Vehicles
and only those Second Division Vehicles with resi-
dential destinations along Orleans Street and Local
or secondary Residential Streets intersecting
Orleans Street, e.q., refuse and recycling vehicles
on the designated pick-up days, school buses on
their scheduled routes and trucks that are provid-
ing deliveries and service;
2. The intersections of Orleans
Street and Donovan Street, Leonard Avenue and
Prestwick Street, are hereby designated
crosswalks and shall be marked and signed
accordingly.
(b) Riverside Drive. Motor vehicle traffic
on Riverside Drive shall be limited to First
Division Vehicles and only those Second Division
vehicles with residential destinations along River-
side Drive, e.g., refuse and recycling vehicles on
the designated pick-up days, school buses on their
scheduled routes and trucks that are providing
deliveries and service; and
16-004 Any person, firm) association,, co -partnership or
corporation violating any provision of this Article
XVI shall be fined not less than $50 nor more than
$750 for each offense,
SECTION 2: That Article VI, Section 13-602 shall be amended,
and all sections appropriately renumbered, to provide for the
following additional speed restriction:
A speed limit of 25 miles per hour is hereby established
in the following areas:
a. Orleans Street; and
b. Riverside Drive, north of Pearl Street.
SECTION 3: That Section 1104 of Chapter 13 of the City's
ordinance regulating traffic and motor vehicles be amended to
provide for the following additional stop street to be designated:
Riverside Drive McCullom Lake Road
SECTION 4: If any section, paragraph, subdivision, clause,
sentence or provision of this Ordinance shall be adjudged by any
Court of competent jurisdiction to be invalid, such judgment shall
not affect, impair, invalidate or nullify the remainder thereof,
which remainder shall remain and continue in full force and effect.
SECTION 5: All ordinances or parts of ordinances in conflict
herewith are hereby repealed to the extent of such conflict.
SECTION 6: This Ordinance shall be in full force and effect
upon its passage, approval and publication in -pamphlet form (which
publication is hereby authorized) as provided by law.
