An Ordinance Amending Section 14-8,, Noise,
of the City of McHenry Municipal Code
to Add Subsection K, Internal Combustion Engines
BE IT ORDAINED by the CITY COUNCIL of the CITY OF McHENRY,
McHenry County, Illinois, as follows:
SECTION 1: That Section 14-8, Noise, of the City of McHenry
Municipal Code shall be amended to add subsection (k), Internal
Combustion Engines, which shall read as follows:
(k) Internal Combustion Engines. Without the prior written
permit of the Director of Building and Zoning, the
operation of or the permitting of` the operation of
internal combustion engines between the hours of 6 p.m.
and 7 a.m., in subdivisions under construction, is pro-
hibited. Any person, firm or corporation violating this
subsection 14-8 (k) shall be fined not less than $750 for
each offense and be responsible for the City's cost of
prosecution including attorneys fees incurred. Each day
that a violation continues shall be considered a separate
offense.
SECTION 2: If any section, paragraph, subdivision, clause,
sentence or provision of this Ordinance shall be adjudged by any
Court of competent jurisdiction to be invalid, such judgment shall
not affect, impair, invalidate or nullify the remainder thereof,
which remainder shall remain and continue in full force and effect.
SECTION 3: All ordinances or parts of ordinances in conflict
herewith are hereby repealed to the extent of such conflict.
SECTION 4: This Ordinance shall be in full force and effect
upon its passage, approval and publication in pamphlet form (which
publication is hereby authorized) as provided by law.

Voting Nay: None.
