AN ORDINANCE
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF MCHENRY, MCHENRY
COUNTY, ILLINOIS, as follows:
SECTION 1. The following Sections of the City of McHenry Municipal
Code relating to the penalty assessed for violation of any Section, Article or
Chapter of the Municipal Code, are hereby amended by increasing the maximum
penalty that can be assessed from $500.00 to $750.00:
Section 1-8 General penalty for violation of Municipal Code
where no specific penalty is provided.
Section 4-31 Alcoholic Beverages
Section 7-30 Buildings & Building Regulations
Section 7-118 Fences
Section 11-39(b) Restaurant (licenses)
Section 12-9 Licenses & Permits Generally
Section 21-76 Encroachments (project or road rights -of -way)
SECTION 2. Section 13-1901(a) of Chapter 13, commonly known as the
Motor Vehicle and Traffic Ordinance relating to the penalty assessed for a
violation of Chapter 13 where no other penalty is provided, is hereby amended
to read as follows:
1113-1901(a) Any person, firm, association, copartnership or
corporation violating any provision of this Ordinance for which
another penalty is not provided, shall be fined not less than Twenty
Five Dollars ($25.00) nor more than Seven Hundred Fifty Dollars
($750.00) for each offense except as provided in Sections 13-1901.1,
13-1901.2, 13-1902 and 13-1903."
SECTION 3. Section 13-1901.2 of the Traffic Ordinance relating to
the Penalty for Illegal Parking in Handicapped Parking Zones is hereby amended
to read as follows:
1113-1901.2 Penalty for Illegal Parking in Handicapped Parking Zones.
The penalty for the offense of parking illegally in a handicapped
parking zone shall be not less than One Hundred Dollars ($100.00)
nor more than Two Hundred Dollars ($200.00).
SECTION 4. Section 13-1901.3 is hereby added to Chapter 13, Motor
Vehicle and Traffic Ordinance, which shall read as follows:
1113-1901.3 Penalty for Passing Stopped School Bus.
The penalty for the offense of passing a school bus that is stopped
for the purpose of receiving or dispensing pupils shall be not less
than One Hundred Fifty Dollars ($150.00), and upon a second or
subsequent violation, shall not be less than Five Hundred Dollars
($500.00), nor more than Seven Hundred Fifty Dollars ($750.00).
SECTION 5. Section 13-1905 of the Traffic Ordinance relating to
Voluntary Settlements Regarding Certain Ordinance Violations shall be amended
by increasing the voluntary settlement for violation of a Handicap Zone from
$50.00 to $100.00 in the columns headed 1148 hours after violation", 48 to 72
hours after violation" and 1172 to 120 hours after violation."
SECTION 6. All ordinances, or parts thereof, in conflict with the
terms and provisions hereof, be and the same are hereby repealed to the extent
of such conflict.
SECTION 7. This ordinance shall be published in pamphlet form by and
under the authority of the corporate authorities of the City of McHenry,
Illinois.
SECTION 5. This ordinance shall be in full force and effect from and
after its passage, approval and publication, as provided by law.
