AN ORDINANCE
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF MCHENRY, MCHENRY
COUNTY, ILLINOIS, as follows:
SECTION 1. Section 7-4 of the City of McHenry Municipal Code relating
to developer cash contributions is hereby amended by adding the following
wording at the end of the first paragraph, after the words "calculated in
accordance with the following schedule,"
"which contributions shall be increased each May 1 by
the percentage increase in the Chicago Area Consumer
Price Index for the previous year, for purposes of
this paragraph, the price index to be used for
comparative purposes shall be that index published
for the Annual Average Chicago Area CPI-U, as
published by the U.S. Department of Labor, Bureau of
Labor Statistics, beginning May 1, 1997:"
SECTION 2. Paragraph H.4.a. of Section V of the Subdivision Control
Ordinance relating to developer cash contributions is hereby amended by
adding the following wording at the end of the first paragraph, after the

SECTION 3. Effective July 1, 1996, the Cash Contribution Schedule set
forth in Section 7-4 of the Municipal Code and Section V. Paragraph H.4.a.
of the Subdivision Control Ordinance, shall be increased to cover the 7.7%
increase in the Consumer Price Index from March 1993 through February, 1996,
as follows:

SECTION 4. Paragraph H.6. of Section V of the Subdivision Control
Ordinance relating to the annual review in February of the developer cash
contribution schedule by the City Council is hereby deleted.
SECTION 5. Any person, firm or corporation violating any provision
of this ordinance shall be fined not less than Twenty Five Dollars
($25.00) nor more than Five Hundred Dollars ($500..00) for each offense
committed on each day during or on which, a violation occurs or continues.
SECTION 6. All ordinances, or parts thereof, in conflict with the
terms and provisions hereof, be and the same are hereby repealed to the
extent of such conflict.
SECTION 7. This ordinance shall be published in pamphlet form by and
under the authority of the corporate authorities of the City of McHenry,
Illinois.
SECTION 8. This ordinance shall be in full force and effect from and
after its passage, approval and publication, as provided by law.
