AN ORDINANCE
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF MCHENRY, MCHENRY
COUNTY, ILLINOIS, as follows:
SECTION 1. Article II, Section 10-19 of Chapter 10 of the City of
McHenry Municipal Code relating to Open Fires is hereby amended to read as
follows:
"Sec. 10-19. Burning leaves, paper generally.
Effective April 15, 1995, it shall be unlawful to
burn paper goods anywhere in the City excepting in a
stove, furnace, incinerator or fireplace so constructed
and used as to prevent the spread of fire by an arresting
screen or similar device which prevents the escape of
igniting particles or burning material therefrom. Leaves
may be burned in the open only on weekends during the
months of October and November, and from April 15 to May
15, if properly piled at least ten (10) feet away from any
structure and attended, provided however, that this may
not be done on a windy day or within 48 hours after a rain
totaling 1/2 inch or more."
SECTION 2. Section 10-20 of Article II of Chapter 10 is hereby
amended to read as follows:
"Sec. 10-20. Burning leaves at night prohibited.
It shall be unlawful to burn leaves, twigs and
branches anywhere in the City excepting from 8:00 o'clock
A.M. to sunset."
SECTION 3. All ordinances, or parts thereof, in conflict with the
terms and provisions hereof, be and the same are hereby repealed to the extent
of such conflict.
SECTION 4. This ordinance shall be published in pamphlet form by and
under the authority of the corporate authorities of the City of McHenry,
Illinois.
SECTION 5. This ordinance shall be in full force and effect from and
after its passage, approval and publication, as provided by law.
