MC-93-606 An Ordinance Amending the City of McHenry Zoning Ordinance Relating to 11C-4" Zoning Districts BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF McHENRY, McHENRY COUNTY, ILLINOIS, as follows: SECTION 1: That Table 6 of the City of McHenry Zoning Ordinance relating to the "C-4" Zoning District is hereby amended to read as follows: "PERMITTED Use Groups [c] L CONDITIONAL Use Groups [d] M" SECTION 2: That Table 7 of the City of McHenry Zoning Ordinance shall be amended to add the following phrase, after the titles in Groups F through K, "Except in the C-4 Zoning Districts." SECTION 3: That Table 7, Group L of the City of McHenry Zoning Ordinance is hereby amended to read as follows: "GROUP L: PERMITTED USES IN C-4 COMMERCIAL DISTRICTS 1. Accessory uses, buildings and structures to all permitted uses in the district, including off --street parking and loading and signs, as provided herein; 2. Antique shops; 3. Art shops or galleries, but not including auction rooms; 4. Automatic teller machines; 5. Automobile parts and accessory stores; 6. Beauty shops, barber shops and hair styling salons; 7. Bicycle sales, rental and repair shops; 8. Blueprinting and photostating establishments; 9. Bookstores or book and stationery stores; 10. Business machines sales, rental and service; 11. Camera and photographic supply stores; 12. Candy, ice cream, popcorn, nut and yogurt stores; 13. Catering establishments; 14. Card and gift stores; 15. Carpet and rug stores (retail sales); 16. China and glassware stores; 17. Clothing repair, hat repair, and shoe repair stores and tailor shops; 18. Clothing and shoe stores; 19. Coin and philatelic stores; 20. Computer sales and rental; 21. Custom dressmaking establishments; 22. Domestic appliance repair shops; 23. Domestic appliance stores, including radio, television, stereo, video, lighting, clock, and music stores; 24. Dwelling units above the ground floor in buildings with a ground floor in non-residential use which are in existence on December 13, 1993; 25 Employment agencies; 26. Financial institutions, including banks, savings and loan associations, and commercial loan offices; 27. Florist shops; 28. Furniture stores, including upholstery when conducted as part of the retail operations and secondary thereto; 29. Garden supply, tool and seed stores, including lawn mower, snow blower and snowmobile sales and service; 30. Health clubs, as defined herein; 31. Hobby and craft shops; 32. Insurance offices; 33. Interior decorating shops, including upholstery and the making of draperies, slip covers and other similar articles when conducted as part of the retail operations and secondary thereto; 34. Jewelry and watch sales and repair stores; 35. Laboratories, medical, dental, research and testing; 36. Leather goods and luggage stores; 37. Locksmith shops; 38. Medical, dental, and optometry offices; 39. Meeting and banquet halls; 40. Millinery shops; 41. Musical instrument sales and repairs; 42. Newspaper, magazine and tobacco shops; 43. Off-street parking lots, public garages or storage garages as principal uses; 44. Offices, business and professional; 45. Offices, governmental, political and institutional; 46. Office, stationery, school, art and graphics supply stores; 47. Optician sales, retail; 48. Orthopedic and medical appliance stores (retail sales only); 49. Paint, tile, and wallpaper stores; 50. Parks, playgrounds, golf courses, forest preserves, wildlife sanctuaries and other publicly owned open spaces; 51. Pawnshops; 52. Permitted public uses, as defined herein; 53. Phonograph record, tape and sheet music stores; 54. Photography studios, including the development of film when conducted as part of the retail business; 55. Photo processing stores (except kiosks); 56. Picture framing shops; 57. Plazas and public spaces; 58. Print shops with six or fewer employees; 59. Radio and television stations and studios; 60. Real estate offices; 61. Recording studios; 62. Schools, commercial, for music, dance, business or trade; 63. Second hand stores and rummage shops; 64. Sewing machine sales and service; 65. Sporting goods stores; 66. Streets and alleys; 67. Tanning salons; 68. Taxidermists; 69. Tax preparation offices; 70. Telegraph offices; 71. Ticket offices, theater and amusement; 72. Ticket offices, transportation; 73. Tourist information and hospitality centers; 74. Toy stores; 75. Trading stamp redemption centers; 76. Travel bureaus; -2- 77. Union halls; 78. Variety stores; 79. Video cassette sales or rentals; 80. Yard goods stores." SECTION 4: That Table 7, Group M of the City of McHenry Zoning Ordinance is hereby amended to read as follows: "GROUP M: CONDITIONAL USES IN C-4 COMMERCIAL DISTRICTS 1. Accessory uses, buildings and structures to all conditional uses in the district, including off-street parking and loading and signs, as provided herein; 2. Animal hospitals; 3. Conditional public uses, as defined herein; 4. Educational institutions, as defined herein; 5. Exhibit halls; 6. Exterminating services; 7. Hotels and motels; 8. Kennels, pet grooming and veterinary offices; 9. Newspaper distribution agencies for home delivery and retail trade; 10. Pet shops; 11. Recreational institutions, as defined herein; 12. Supermarkets; 13. Theaters, indoor." SECTION 5: Any person, firm or corporation violating any provision of this ordinance shall be fined not less than Twenty Five Dollars ($25.00) nor more than Five hundred Dollars ($500.00) for each offense committed on each day during, or on which, a violation occurs or continues. SECTION 6: All ordinances or parts thereof, in conflict with the terms and provisions hereof, be and the same are hereby repealed to the extent of such conflict. SECTION 7: This ordinance shall be published in pamphlet form by and under the authority of the corporate authorities of the City of McHenry, Illinois. SECTION 8: This ordinance shall be in full force and effect from and after its passage, approval and publication, as provide by law. PASSED and APPROVED this 13th day of December, 1993. AYES: Baird.
