AN ORDINANCE
WHEREAS, the City of McHenry filed a petition with the Zoning Board of Appeals
praying that the Zoning Board of Appeals make recommendations to the City Council concerning
proposed amendments of certain provisions of the Zoning Ordinance of the City of McHenry;
and
WHEREAS, a public hearing was held before the Zoning Board of Appeals of the City
pursuant to proper notice therefore having been given as provided by law; and
WHEREAS, the Zoning Board of Appeals heard and considered evidence at said hearing
and regarded the allegations contained in said petition; and
WHEREAS, the Zoning Board of Appeals of the City of McHenry has recommended the
amendments of the Zoning Ordinance hereinafter described.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF McHENRY,
McHENRY, ILLINOIS, AS FOLLOWS:
SECTION 1. That the Zoning Ordinance of the City of McHenry, Illinois is hereby
amended as follows:
a. Delete from item No. 7 in Table 1 of the Zoning Ordinance the
requirement for a retained personnel fee deposit for sign permit and minor
variances.
b. Change Section IIID to read as follows:
"Except as may be provided for by annexation agreement or by a
subsequent amendment to this Ordinance, any lot or parcel of land
hereafter annexed to the City shall be automatically classified E,
RS1, RS2, RS3 or RS4 Zoning District "RS" Classification,
whichever is most restrictive, provided however that the area of
the annexed parcel or lot is in conformance with the minimum lot
area requirement of that District."
C. Change footnote (8) in Table 18 of the Zoning Ordinance to read as
follows:
"Wall Signs: May locate on principal building walls facing public streets
or off-street parking areas only. May project one (1) foot into required
yard.
d. Change the definition of the term "Planned Unit Development" in Section
XIX by deleting therefrom the words "five (5) acres" and substituting in
place thereof the words "two (2) acres".
SECTION 2. Any person, firm or corporation violating any provision of this ordinance
shall be fined not less than Twenty Five Dollars ($25.00) nor more than Five Hundred Dollars
($500.00) for each offense committed on each day during, or on which, a violation occurs or
continues.
SECTION 3. All ordinances, or parts thereof, in conflict with the terms and provisions
hereof, be and the same are hereby repealed to the extent of such conflict.
SECTION 4. This ordinance shall be published in pamphlet form by and under the
authority of the corporate authorities of the City of McHenry, Illinois.
SECTION 5. This ordinance shall be in full force and effect from and after its passage,
approval and publication in pamphlet form, as provided by law.
