MC-91-556 AN ORDINANCE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF McHENRY, McHENRY, ILLINOIS, as follows: SECTION 1. Section 26-2(b) of the Municipal Code, City of McHenry, is hereby amended by changing the permit fee for a water connection permit for all diameters of pipe taps at the water main to $150. The charge for the cost of water meter shall remain unchanged. SECTION 2. Section 26-102 of the Municipal Code, City of McHenry, which established various classes of building sewer permits is hereby repealed. SECTION 3. Section 26-104 of the Municipal Code, City of McHenry, is hereby amended to read as follows: "Section 26-104. PERMIT, INSPECTION FEE. A permit and inspection fee in the amount of $150 shall be charged for each sanitary sewer connection and shall be paid at the time application for permit is filed." SECTION 4. Section 26-166 of the Municipal Code, City of McHenry, is hereby amended to read as follows: "Section 26-166. AMOUNT. The water and sewer capital development fee for residential and non-residential buildings shall be as follows: A. FOR RESIDENTIAL BIILDINGS/USES: (1) Detached Single -Family Residence: Two bedroom or less Three bedroom Four bedroom Five bedroom or more WATER SEWER $ 615 $ 980 891 1,418 1,142 1,818 1,119 1,781 (2) Attached Single -Family Residence: Two bedroom or less 645 1,027 Three bedroom 740 1,178 Four bedroom or more 1,037 1,651 (3) Apartments• Two bedroom or less 545 867 Three bedroom or more 866 1,379 B. FOR NON-RESIDENTIAL BUILDINGS/USES: (1) Capital Development Fees For Non -Residential Uses. The capital development fee for connecting a non- residential building or use to the City water and sewer system within its Corporate limits, shall be the water and sewer capital development fee charged for a three bedroom detached single-family residence per each Equivalent Dwelling Unit as hereinafter defined. (2) Equivalent Dwelling Unit. The number of Equivalent Dwelling Units used to determine water and sewer connection charges for non-residential buildings shall be based upon "A System of Computerized Models for Calculating and Evaluating Municipal Water Requirements and Forecasting Municipal Water Requirements" prepared by Hittman Associates, Inc. for the Office of Water Resources Research, United States Department of the Interior. The Commercial and Industrial Categories and Usage Coefficient Values for the Library of Water Usage Parameters, Tables AIII.2 through AIII.6, delineate the expected usage coefficients for the mean annual water usage expected in commercial and industrial categories. These values shall be used in the formula to determine Equivalent Dwelling Units. Due to the length of the documents referred to above, three (3) copies of said documents shall remain on file for public inspection in the office of the City Clerk. These documents are hereby adopted by reference. (3) Average Daily Water Usage. The average daily water usage for a detached single-family residence having three bedrooms is hereby determined to be 300 gallons. (4) Equivalent Dwelling Unit Formula. The Equivalent Dwelling Unit for industrial and commercial buildings shall be determined by using the following formula: (a) For Industrial Buildings/Uses: Multiply the Mean Annual Expected Usage Coefficient of the industrial category seeking connection times the maximum number of employees planned to occupy such industrial building and divide the sum thereof by the average daily water usage for a detached single family residence having three bedrooms. (Calculation of Equivalent Dwelling Units (EDU) for Miscellaneous Manufacturing category employing 50 persons, illustrated: 258.270 x 50 - 43.045 EDU's) 300 -2- (b) For Commercial Buildings/Uses: Multiply the Mean Annual Expected Usage Coefficient of the commercial category seeking connection times the number of Parameter units applicable to such commercial connection and divide the sum thereof by the average daily water usage for a detached single-family residence having three bedrooms. (Calculation of Equivalent Dwelling Units (EDU) for a 10,000 sq. ft. Office building, illustrated: .093 x 10,000 sq. ft. = 3.1 EDU'S) 300 SECTION 5. Any person, firm or corporation violating any provision of this ordinance shall be fined not less than Twenty -Five Dollars ($25.00) nor more than Five Hundred Dollars ($500.00) for each offense committed on each day during, or on which, a violation occurs or continues. SECTION 6. All ordinances, or parts thereof, in conflict with the terms and provisions hereof, be and the same are hereby repealed to the extent of such conflict. SECTION 7. This ordinance shall be published in pamphlet form by and under the authority of the corporate authorities of the City of McHenry, Illinois. SECTION 8. This ordinance shall be in full force and effect from and after its passage, approval and publication as provided by law. PASSED this 27th day of March, 1991.
