AN ORDINANCE
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF NCHENRY,
NCHENRY COUNTY, ILLINOIS, as follows:
SECTION 1. Chapter 11 of the Municipal Code, City of McHenry,
Illinois, is hEreby amended by adding the followin.1 provisions as and
for Article VII pertaining to Leaf Pick -Up Service:
ARTICLE VII.
LEAF PICK-UP SERVICE
Section 11-220. Fall Leaf Pick -Up Service. The City will
provide a leaf pic -up service or singe imily residence and
duplex properties located within the City, during the Fall season
of the year on dates and at times to be announced by the City.
Section 11-221. Authorized Leaf Pick -Up Bags. The City will
only pick up leaves that are contained in a bag provided by the
City for purchase from designated retail outlets. The bags shall
be sold by the retail outlets and at the City Hall at the price
of 500 each.
Section 11-222. Curb -Line or Road -Line Collection. Bagged
leaves shall be placed or pick-up in the parkway of the' premises
making such placement.
Section 11-223. Unlawful Bag Contents; Intent Presumed. It
shall be unlawful or any person to pace a leaf pick-up bag at
curbside for pick-up containing any garbage, trash, refuse or
other waste materials. It shall be presumed that the contents of
the leaf pick-up bags were known to and authorized by the Owner
or Occupant of the premises from which said bags were deposited
for pick-up. '

Section 11-224. Rejection of Pick -Up. No pick-up will be made
by the City if the leaves are not contained in City -provided
bags, or, if such City -provided bag contains something other than
leaves. Unbagged leaves and rejected bags or containers shall be
immediately removed by the Owner or Occupant of the premises from
which the pick-up was offered.
SECTION 2. Any person, firm or corporation
violating any provision of this ordinance shall be fined
not less than Twenty Five Dollars ($25.00) nor more than
Five Hundred Dollars ($500.00) for each offense committed
on each day during, or on which, a violation occurs or
continues.
SECTION 3. All ordinances, or parts thereof, in
conflict with the terms and provisions hereof, be and the
same are hereby repealed to the extent of :such conflict.
SECTION 4. This ordinance shall be published in
pamphlet form by and under the authority of the corporate
authorities of the City of McHenry, Illinois.
SECTION 5. This ordinance shall be in full force
and effect from and after its passage,, approval and
publication in pamphlet form, as provided by law.
