AN ORDINANCE
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
MCHENRY, MCHENRY COUNTY, ILLINOIS, AS FOLLOWS:
SECTION 1. Sections 26-15 and 26-79 of the Municipal
Code, City of McHenry, Illinois, be and the same are hereby
amended to read as follows:
Section 26-15. Responsibility for Installation;
Supervision. Where, prior to July 6, 1965, water mains
have been installed without a stub to the boundary line
of the adjoining property, such stub shall be installed
by the City at its own expense, unless since July 6,
1965 such adjoining property had been part of a larger
tract of -land at whose ooundary line a stub existed or
to which a main had been installed at the City's
expense. All service lines from the mains to the water
distribution system of any premises shall be installed
by and at the sole cost and expense of the owner of the
property to be served or the applicant for the service.
Such installation shall be inspected by and made under
the supervision of the Superintendent of Public Works.
Section 26-79. Responsibility for Installations;
Supervision. Where, prior to July 6, 1965, sewer mains
have been installed without a stub to the boundary line
of adjoining property, such stub shall be installed by
the City at its own expense, unless such adjoining
property had been part of a larger tract of land since
July b, 1965, at whose boundary line a stub existed or
to which a main had been installed at the City's
expense. All service lines from the sewer main to any
premises shall be installed by and at the sole cost and
expense of the owner of the property to be served or
the applicant for the service. Such installation shall
be inspected by and made under the supervision of the
Superintendent of Public Works.
SECTION 2. Paragraph I of Section V of the Subdivision
Control Ordinance of the City of McHenry is hereby amended
by adding thereto the following provision as and for an
additional paragraph thereof:
"Where any premises which are entitled to have the City
install sewer and water stubs at the boundary thereof
pursuant to Sections 26-15 and 26-79 of the Municipal
Code are subdivided prior to such installation by the
City, only one parcel thereof, as designated by the
City, shall be entitled to such sewer and water
installation by the City after such subdivision."
SECTION 3. Any person, firm or corporation violating
any provision of this ordinance shall be fined not less than
Twenty Five Dollars ($25.00) nor more than Five Hundred
Dollars ($500.00) for each offense committed on each day
during, or on which, a violation occurs or continues.
SECTION 4. All ordinances, or parts thereof, in
conflict with the terms and provisions hereof, be and the
same are hereby repealed to the extent of such conflict.
SECTION 5. This ordinancE' shall be published in
pamphlet form by and under the authority of the corporate
authorities of the City of McHenry, Illinois.
SECTION 6. This ordinance shall be in full force and
effect from and after its passage, approval and publication
in pamphlet form, as provided by law.
