HomeMy WebLinkAboutOrdinances - MC-89-486 - 05/03/1989 - Ch 13 Traffic codification of Article XIIOrdinance No. MC-89-486 AN ORDINANCE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF McHENRY, McHENRY COUNTY, ILLINOIS AS FOLLOWS: SECTION 1. Article XII of Chapter 13 of the Municipal Code, City of McHenry, Illinois, commonly known as the Traffic and Motor Vehicle Ordinance of the City of McHenry, Illinois, be and the same is hereby codified as set forth in the draft of said Article XII attached hereto as Exhibit 1 and incorporated herein by reference. SECTION 2. Any person, firm or corporation violating any provision of the aforesaid Article XII shall be fined not less than Twenty Five Dollars ($25.00) nor more than Five Hundred Dollars ($500.00) for each offense committed on each day during, or on which, a violation occurs or continues. SECTION 3. All ordinances, or parts thereof, in conflict with,,the terms and provisions hereof, be and the same are hereby repealed to the extent of such conflict. SECTION 4. This ordinance shall be published in pamphlet form by and z:nder the authority of the corporate authorities of the City of McHenry, Illinois. SECTION 5. This ordinance shall be in full force and effect from and after its passage, approval and publication, as provided by law. PASSED THIS 3rd day of May , 1989. AYES: Bolger, Donahue, Lieder, McClatchey, Patterson, Serritella, Smith, Teta NAYS: None ABSTAINED: None ABSENT: None NOT VOTING: None APPROVED this 3rd day of May 1989 W� 0 ATTEST: ARTICLE XII Parking Regulations 13-1201 STOPPING, STANDING OR PARKING PROHIBITED IN SPECIFIED PLACES Except when necessary to avoid conflict with other traffic or in compliance with law or the directions of a police officer or official traffic -control device, no person shall: A. Stop, stand or park a vehicle; 1. On the roadway side of any vehicle stopped or parked at the edge or curb of a street; 2. On a sidewalk; 3. Within an intersection; 4. On a crosswalk; 5. Between a safety zone and the adjacent curb or within 30 feet of points on the curb immediately opposite the ends of a safety zone, unless a different length is indicated by signs or markings; 6. Alongside or opposite any street excavation or obstruction in which stopping, standing or parking would obstruct traffic; 7. Upon any bridge or other elevated structure or upon a highway; 8. On any railroad tracks; 9. At any place where official signs prohibit stopping; 10. In the area between roadways or a divided highway, including crossovers; 11. Between the curb and gutter and the sidewalk on same side of street; 12. Between the curb and gutter and the right-of-way boundary line on the same side of street, where there is no existing sidewalk. B. Stand or park a vehicle, whether occupied or not, except momentarily to pick up or discharge passengers: 1. In front of a public or private driveway; 2. Within 15 feet of a fire hydrant; 3. Within 20 feet of a crosswalk at an intersection; 4. Within 30 feet upon the approach to any flashing signal, stop sign, yield sign, or traffic control signal located at the side of a roadway; Exhibit l 5. Within 20 feet of the driveway entrance to any fire station, and on the side of a street opposite the entrance to any fire station within 75 feet of such entrance (when properly sign -posted); 6. At any place where official signs prohibit standing. C. Park a vehicle whether occupied or not, except temporarily for the purpose of and while actually engaged in loading or unloading property or passengers: 1. Within 50 feet of the nearest rail or railroad crossing; 2. At any place where official signs prohibit parking. D. Move a vehicle not lawfully under his control into any such prohibited area or away from a curb such distance as is unlawful. 13-1202 ADDITIONAL PARKING REGULATIONS A. Except as otherwise provided in this Section, every vehicle stopped or parked upon a two-way roadway shall be so stopped or parked with the right-hand wheels parallel to and within 12 inches of the right-hand curb or as close as practicable to the right edge of the right-hand shoulder; B. Except as otherwise provided by ordinance, every vehicle stopped or parked upon a one-way roadway shall be so stopped or parked parallel to the curb or edge of the roadway, in the direction of authorized traffic movement, with its right-hand wheels within 12 inches of the right-hand curb or as close as practicable to the right edge of the right-hand shoulder, or with its left-hand wheels within 12 inches of the left-hand curb or as close as practicable to the left edge of the left-hand shoulder. 13-1203 PARKING NOT TO OBSTRUCT TRAFFIC No person shall park any vehicle upon a street in such a manner or under such conditions as to leave available less than fifteen feet of the width of the roadway for free movement of vehicular traffic on a two-way street or less than ten feet of the width of the roadway for free movement of vehicular traffic on a one-way street. 13-1204 STOPPING, STANDING OR PARKING IN ALLEYS A. No person shall stop, stand or park any vehicle in any alley for a period of time longer than is necessary for the reasonable expeditious loading or unloading of such vehicles; B. No person shall stop, stand or park a vehicle within an alley in such a manner or under such conditions as to leave available less than ten feet of the width of the roadway for the free movement of vehicular traffic; -2- C. No person shall stop, stand or park a vehicle within an alley in such position as to block the driveway or entrance to any abutting property. 13-1205 PARKING LIMITED DURING SNOW REMOVAL It is unlawful to park any vehicle for a period of time longer than three minutes for loading or unloading of passengers or thirty minutes for loading or unloading of property in any place, whether designated as a loading zone or not so designated on the paved portion of any roadway, at anytime after snow begins to fall and for a period of eight hours after snow stops falling, if the snow on the street exceeds two inches in depth, provided that said eight -hour parking restriction shall continue during snow removal operations until completed. 13-1206 PARKING FOR CERTAIN PURPOSES PROHIBITED No person shall park a vehicle upon any roadway for the principal purpose of: A. Displaying such vehicle for sale; B. Washing, greasing, or repairing such vehicle except such repairs necessitated by an emergency. 13-1207 CURB MARKINGS Any area in which the curb is painted yellow shall be designated a no -parking zone, whether or not signs are posted to that effect. 13-1208 FIRE LANES It shall be unlawful for any vehicle to occupy an area set aside as a fire lane whether established on public property by ordinance or on private property by agreement. 13-1209 ALL NIGHT PARKING PROHIBITED To make possible the cleaning of the streets and the removal of snow and ice, it shall be unlawful to park any motor vehicle on or upon the paved portion of any roadway within the corporate limits of the City, between the hours of 2:00 a.m. and 6:00 a.m. at any time. 13-1210 ANGLE PARKING ONLY Only angle parking shall be permitted in the following areas: A. RIVERSIDE DR from Boone Creek north to 200 feet north of Pearl Street; -3- B. MAIN STREET from the easterly edge of the Chicago and Northwestern Railroad property to 150 feet east of Front Street; C. GREEN STREET from Elm Street south to the northerly edge of the Green Street bridge over Boone Creek. 13-1211 thru 13-1219 RESERVED 13-1220 PERMIT PARKING ONLY A. It is unlawful to park any vehicle in any of the the following described locations, which are hereby designated as "Permit Parking Only" spaces, unless such parking space has been leased pursuant to paragraph B of this Section and such vehicle displays a current parking permit on the right hand side of the rear window of such vehicle; 1. PARK STREET the southernmost 13 parking spaces on the west side adjacent to Veterans Memorial Park. (Seg Appendix A-2 on page 134 hereof); 2. COURT STREET MUNICIPAL PARKING LOT the northernmost and the southernmost parking lot spaces (See Appendix A-3 on page 135 hereof); 3. GREEN STREET MUNICIPAL PARKING LOT the 23 parking spaces designated as "Zone D" in the Green Street Municipal Parking Lot (See Appendix A-1 on page 133 hereof); B. The aforesaid parking spaces may be leased for a term of not less than 3 months nor more than 12 months in duration, for a quarterly rental fee of $15.00 each, payable in advance, and shall be made available on a first -come, first -served basis. The terms of the quarterly permit shall be for the following months: March through May, June through August, September through November, and December through February. No portion of the permit fee shall be refundable under any circumstances; C. In order to enable the City to snow plow the permit parking spaces, the parking of motor vehicles thereon shall be prohibited from the time that snowfall exceeds a depth of two (2) inches thereon on until the parking spaces have been snow plowed by the City. 13-1221 TRAILER PARKING PROHIBITED It shall be unlawful for any person to park any boat trailer, whether attached to a motor vehicle or not, on any part of Riverside Drive located south of Elm Street. 13-1222 NO PARKING AT ANY TIME It shall be unlawful for the operator of any motor vehicle to park: such vehicle at any of the following locations at any time: -4- 1. BORDEN STREET on the east side from Main Street to Elm Street; 2. COMMERCIAL AVE from Highview Avenue east to Meadow Lane; 3. CRYSTAL LAKE RD on both sides of the street from Elm Street to the northern line of Hanley Street; 3.1 CRYSTAL LAKE RD along the west side of the street from Royal Drive to the south boundary of McHenry West Campus High School; 4. ELM STREET on the south side from 200 feet west of Third Street to Richmond Road; 4.1 ELM STREET on the north side in a northeasterly direction from the center line of Front Street for a distance of 150 feet; 4.2 ELM STREET on the south side from Third Street to the Boone Creek bridge; 5. FREUND AVENUE along the east side of the street from Elm Street to a point 300 feet north of Elm Street; 6. FRONT ROYAL DR on the east side of the street from Manchester Mall to Elm Street; 7. FRONT STREET along the east side of the street from Elm Street to a point 300 feet north of Elm Street; 7.1 FRONT STREET on both sides of the street for a distance of 50 feet south from Main Street; 7.2 FRONT STREET along the east side from the north driveway thereon of the First National Bank of McHenry to a point eighty feet north thereof; 8. GREEN STREET along the west side of the street between Washington Street and Pearl Street; 8.1 GREEN STREET along the west side of the street from Waukegan Road to a point 300 feet north of Waukegan Road; 8.2 GREEN STREET on both sides of the street from Waukegan Road to John Street; 8.3 GREEN STREET along the west side of the street from John Street to Kane Avenue; 8.4 GREEN STREET from Kane Avenue south for 500 feet on the east side of the street; 8.5 GREEN STREET on east side of Green Street along the entire front of the Post Office Building; -5- 8.6 GREEN STREET on the west side of the Boone Creek bridge except that this area shall be reserved exclusively for parking Regional Transportation Authority buses; 9. HIGHVIEW AVE both sides of the street from Elm Street to Home Avenue; 10. INDUSTRIAL DR the entire length of the street along both sides; 11. JOHN STREET on both sides of the street from Green Street to the west boundary of the McHenry Country Club; 12. KANE AVENUE north side along the entire fenced portion of McCracken Field during any events; 12.1 KANE AVENUE along the north side of the street from Green Street to a point 200 feet west of Green Street; 12.2 KANE AVENUE along the north side of the street from Center Street to a point 200 feet east of Center Street; 13. LILLIAN STREET the entire length of the street along both sides; 14. MAIN STREET along the south side of the street from a point 150 feet east of Front Street to Green Street; 15. MEADOW LANE both sides from Elm Street to Shore Drive; 16. PEARL STREET along the north side of the street between Park Street and Green Street; 16.1 PEARL STREET along the south side of the street between Richmond Road and Court Street except in the spaces provided; 17. PETERSON PARK RD along both sides of the road for the entire length of the road, except in spaces provided; 18. RAMBLE ROAD both sides of the street from Elm Street to Home Avenue; 19. RICHMOND ROAD on the east side of the road from Elm Street to Pearl Street; 20. RIVERSIDE DR along the east side of the street between the north City limit and a point 200 feet south of Broad Street; S� 20.1 RIVERSIDE DR along the east side from Elm Street to a point 100 feet north of Elm Street; 21. ROYAL DRIVE on the north side for a distance of 35 feet east from the intersection with Northfox Lane; 22. SUNSET DRIVE on the east side from the creek bridge to the corner of Willow Lane; 23. THIRD STREET on both sides of the street from Waukegan Road to Elm Street; 24. WAUKEGAN ROAD on the south side of the street from Green Street to the Fox River; 24.1 WAUKEGAN ROAD on the south side of the street from Green Street to a point 88 feet west of Green Street; 24.2 WAUKEGAN ROAD on the south side of the street from Third Street to a point 39 feet east of Third Street; 24.3 WAUKEGAN ROAD on the south side of the street from a point 211 feet east of Third Street to a point 311 feet east of Third Street (in front of the White House Kindergarten); 24.4 WAUKEGAN ROAD on the north side of the street from Green Street to Fourth Street; 24.5 WAUKEGAN ROAD on the north side of the street from the east line of the entrance to the McHenry Villa to the Fox River. 13-1223 NO PARKING 6:00 A.M. to 6:00 P.M. It shall be unlawful for the operator of any motor vehicle to park such vehicle between the hours of 6:00 A.M. to 6:00 P.M. in any of the following locations: 1. RIVERSIDE DRIVE - adjacent to 1312 N. Riverside Drive. 13-1224 NO PARKING 8:00 A.M. to 4:00 P.M. ON SCHOOL DAYS It shall be unlawful for the operator of any motor vehicle to park such vehicle for more than two (2) consecutive hours on school days between the hours of 8:00 A.M. and 4:00 P.M. in any of the following locations: 1. ALLEN AVENUE its entire length on both sides of the street; -7- 2. JOHN STREET both sides from Green Street to Fourth Street. 13-1225 PARKING FOR MEDICALLY HANDICAPPED PERSONS A. It shall be unlawful for any person, other than a medically handicapped person, to park any motor vehicle in any of the following locations, which shall be marked by the appropriate signs: 1. CENTER STREET the five (5) northern most parking spaces on the east side of Center Street adjoining the First United Methodist Church from 8:00 A.M. to 12:00 Noon on Sundays only; 2. ELM STREET the westerly most parking space on the north side of Elm Street east of Front Street; 2.1 ELM STREET the first parking space east of Green Street on the south side of Elm Street; i 3. GREEN STREET one parking space abutting on the north and on the south of the no parking zone (in front of the McHenry Medical Group entrance); 3.1 GREEN STREET the northern most parking space in front of 1111 N. Green Street; 3.2 GREEN STREET the northern most parking space on the east side of Green Street south of Pearl Street; 3.3 GREEN STREET the parking space abutting the fire hydrant no parking area in front of 1228 N. Green Street; 4. MAIN STREET the parking space on the south side of the street abutting the west side of the entrance to the City Parking Lot; 4.1 MAIN STREET the 7th parking space west of Front Street on the south side; 4.2 MAIN STREET the parking space adjoining the street light pole at the east corner of the Depot Hotel at 3941 W. Main Street; 5. RIVERSIDE DR the northern most parking space on the west side of the street south of Pearl Street; 5.1 RIVERSIDE DR the parking space on the east side of the street in front of the entrance to 1314 N. Riverside Drive; 5.2 RIVERSIDE DR the parking space in front of 1334 N. Riverside Drive; in B. Parking spaces set aside for medically handicapped persons may be occupied by motor vehicles displaying a State of Illinois medically handicapped registration plate, or an Illinois Disabled Person Identification Card issued pursuant to the Illinois Identification Card Act or a City of McHenry or other municipality medically handicapped person identification card; such identification card may be obtained without charge from the City Clerk upon request supported by written certification from a medical doctor addressed to the City of McHenry that the applicant for the card is a medically handicapped person. The medically handicapped parking card shall be prominently displayed on the dashboard of the vehicle, or attached to the visor thereof, and shall be visible through the front windshield of the vehicle; C. Vehicles bearing the aforementioned medically handicapped parking cards or registration plates, when parked in other areas of the City are exempt from any ordinance imposing time limitations on parking, but are subject to the provisions of all other parking ordinances. 13-1226 FIFTEEN (15) MINUTE PARKING a A. It shall be unlawful for the operator of any motor vehicle to park such vehicle in any of the following locations except for loading or unloading, which time shall not exceed 15 minutes: 1. PEARL STREET in front of 3308 Pearl Street; 2. RIVERSIDE DR along the west side from a point 39 feet south of Elm Street to 60 feet south of Elm Street; B. It is unlawful for any person to park any vehicle for a consecutive period of time longer than 15 minutes at the following locations: 1. JOHN STREET north side from Green Street easterly to the existing driveway of the school parking lot; 2. GREEN STREET the southernmost four parking spaces in front of City Hall. 13-1227 TWO (2) HOUR PARKING BETWEEN 8:00 A.M. and 6:00 P.M. Except Sunday It shall be unlawful for the operator of any motor vehicle to park such vehicle for more than two consecutive hours between the hours of 8:00 A.M. to 6:00 P.M. except Sunday in the following locations: 1. COURT STREET along both sides of the street from Venice Avenue to Elm Street; 1.1 COURT STREET from Elm Street to Pearl Street; 2. FRONT STREET along the west side of the street from Elm Street to Main Street; 10 3. GREEN STREET along the west side of the street north of Elm Street, between Elm Street and the south entrance to McHenry State Bank parking lot; 3.1 GREEN STREET along the east side of the street between Pearl Street and Broad Street; 3.2 GREEN STREET along the west side of the street from Kane Avenue to a point 500 feet south of Kane Avenue; 4. KANE AVENUE along the south side of the street from Green Street to Center Street; 5. PARK STREET along both sides of the street from Venice Avenue to Elm Street and from Elm Street to Pearl Street; 6. PEARL STREET on the north side of the street between Richmond Road and Green Street; 6.1 PEARL STREET along the south side of the street from.Court Street to Park Street. 13-1228 TWO (2) HOUR PARKING It shall be unlawful for the operator of any motor vehicle to park such vehicle for more than two consecutive hours in the following locations: 1. COURT STREET MUNICIPAL PARKING LOT (except for permit parking areas, see Section 13-1220) 2. ELM STREET both sides from the westerly edge of Riverside Drive to the easterly edge of Front Street; 3. GREEN STREET both sides from Pearl Street to Waukegan Road 4. MAIN STREET from the easterly edge of the Chicago and Northwestern property to a point 150 feet east of Front Street on both sides of Main Street; 5. PEARL STREET from Green Street to a point 150 feet east of Green Street on the south side only; 5.1 PEARL STREET from Park Street to the Fox River on both sides; 6. RIVERSIDE DR from Elm Street to a point 200 feet north of Pearl Street on both sides of Riverside Drive; 7. WAUKEGAN ROAD from Green Street to the westerly edge of the main entrance to McHenry Villa on the north side of Waukegan Road; -10- 7.1 WAUKEGAN ROAD from a point on the north side thereof 100 feet east of its intersection with Front Street, thence easterly to Third Street; 7.2 WAUKEGAN ROAD on the south side thereof from a point 175 feet east of its intersection with Front Street, thence easterly to Third Street. 13-1229 FOUR (4) HOUR PARKING 6:00 A.M. to 6:00 P.M. EXCEPT SATURDAY, SUNDAY AND HOLIDAYS It shall be unlawful for the operator of any motor vehicle to park such vehicle for a period of time longer than 4 (four) consecutive hours from 6:00 A.M. to 6:00 P.M. except Saturdays, Sundays and Holidays, at any of the following locations: 1. PARK STREET west side between Pearl Street and Broad Street; 2. BROAD STREET south side between Park Street and Court Street; 3. COURT STREET east side between Broad Street and Pearl Street. 13-1230 FOUR (4) HOUR PARKING It shall be unlawful for the operator of any motor vehicle to park such vehicle for a period of time longer than four (4) hours at the following described locations: 1. Zone A Green Street Municipal Parking Lot (see Appendix A-1, page 133 hereof) 2. Zone B Green Street Municipal Parking Lot (see Appendix A-1, page 133 hereof); 13-1231 FOUR (4) HOUR PARKING 8:00 A.M. TO 6:00 P.M. EXCEPT SUNDAY It shall be unlawful for the operator of any motor vehicle to park such vehicle between the hours of 8:00 A.M. and 6:00 P.M. except Sunday at any of the following locations: 1. MAIN STREET Public Parking Lot. 13-1232 THRU 13-1245 RESERVED 13-1246 AUTHORITY TO IMPOUND VEHICLES A. Members of the Police Department of the City of McHenry are hereby authorized to remove any vehicle from any street, highway, alley, -11- municipal parking lot and other municipal property and to cause said vehicle to be stored at the City Vehicle Pound or authorized garage as determined and designated by the Chief of Police under any of the following circumstances: 1. When any vehicle is left unattended upon any bridge or upon any approach thereto, where such vehicle constitutes an obstruction to traffic; 2. When a vehicle is so disabled as to constitute an obstruction to traffic and the person or persons in charge of the vehicle are, by reason of physical injury, incapacitated to such an extent as to be unable to provide for its custody or removal; 3. When any vehicle is left unattended and is so parked illegally as to constitute a possible hazard or obstruction to the normal movement of traffic; 4. When any abandoned vehicle is found on any street, highway, alley, municipal parking lot or other municipal property; 5. When any motor vehicle has been parked on any street, highway, alley, municipal parking lot or other municipal property for a period of 24 consecutive hours; 6. When any vehicle is parked in violation of Section 13-1205 (snow removal) or 13-1208 (fire lanes); 7. When any vehicle is parked in violation of official signs indicating that parking, standing or stopping is prohibited at all times or during designated hours or prohibited for longer than indicated on such sign. B. Vehicles so towed and removed shall be restored to the owner or operator thereof after the payment of the expense incurred by the City in removing and storing such vehicles. 13-1247 PERSON RESPONSIBLE FOR VIOLATION Whenever any vehicle shall have been parked in violation of any of the p,rovisions of any ordinance prohibiting or restricting parking, the person in whose name such vehicle is registered shall be prima facie responsible for such violation and subject to the penalty therefore. 13-1248 POSTING OF SIGNS The Superintendent of Public Works shall erect or cause to be erected signs that clearly indicate the parking regulations contained in this article. -12-
