A RESOLUTION PROVIDING FOR AN AMENDMENT
TO THE BOONE CREEK VENTURE SUBDIVISION
UNIT III FINAL PLAT.
WHEREAS, the McHenry City Council at its regularly
scheduled Council Meeting held on February 2, 2000 authorized
the approval of the Final Plat of Boone Creek Subdivision Unit III
by a three to two vote; and
WHEREAS, the approval of said Final Plat was conditioned
upon certain language being included on the Plat, to wit:
"The following restrictions apply to Lots 75,89,113,142 and 143;
1. Fencing is prohibited within twenty (20) feet of the right-of-way
line of Dartmoor Drive;
2. Fencing installed parallel to the right-of-way line of Dartmoor Drive
shall be five (5) feet in height with a natural color and a standard
flat top board on board design;
3. The berm as originally installed by the developer parallel to
Dartmoor Drive shall not be removed and is the maintenance
responsibility of each prospective lot owner;
4. The Primary Structure on Lot 142 shall not be within 10 feet of the
Lift Station Easement"; and
WHEREAS, the City Council of the City of McHenry intends
to amend the Final Plat of Boone Creek Subdivision Uhit III by the
inclusion of the aforesaid language.
NOW THEREFORE, BE IT RESOLVED, the Mayor and City
Council of the City of McHenry go on record approving the
inclusion of restrictive language on the Final Plat of Boone Creek
Subdivision Unit III.
BE IT FURTHER RESOLVED, that this resolution be
recorded with the McHenry County Recorder of Deeds immediately
following the recordation of the Final Plat of Boone Creek
Subdivision Unit III.
