ORDINANCE NO.MC-87-416
AN ORDINANCE
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
MCHENRY, MCHENRY COUNTY, ILLINOIS; AS FOLLOWS:
SECTION 1. Section 16-1 of the MunicipalCode, City
of McHenry, Illinois, is hereby amended by changing the
definition of the word "Park" to read as follows:
"Park means a park, reservation, playground,
beach, recreation center, McCullom Lake, or any
other area in the City, owned or used by the City,
and devoted to active or passive recreation."
SECTION 2. Section 16-11 of the Municipal Code,
McHenry, Illinois is hereby amended by adding
the following additional provision:
"This section is not intended to prohibit the
taking of fish by legal means."
SECTION 3. Section 16-21 of the Municipal Code,
City of McHenry, Illinois is hereby amended to read as
follows:
"Section 16-21. Reckless Operation of Boats. No
person shall operate any boat on any body of water
within the City Limits of the City of McHenry,
Illinois with a willful or wanton disregard for the
safety of persons or property, nor in such a manner
as to annoy, frighten or endanger any other person
who may then be on or in any such body of water."
SECTION 4. Section 16-46 of the Municipal Code,
City of McHenry, Illinois is hereby amended to read as
follows:
"Section 16-46. Airplanes Prohibited on McCullom
Lake and Other Bodies of Water in the City. No
person shall operate any airplane on any portion of
McCullom Lake which is located within the City
Limits, nor upon any other body of water which is
located within the City Limits."
SECTION 5. Any person, firm or corporation
violating any provision of this ordinance shall be fined
not less than Twenty Five Dollars ($25.00) nor more than
Five Hundred Dollars ($500.00) for each offense committed
on each day during, or on which, a violation occurs or
continues.
SECTION 6. All ordinances, or parts thereof, in
conflict with the terms and provisions hereof, be and the
same are hereby repealed to the extent of such conflict.
SECTION 7. This ordinance shall be published in
pamphlet form by and under the authority of the corporate
authorities of the City of McHenry, Illinois.
SECTION 8. This ordinance shall be in full force
and effect from and after its passage, approval and
publication in pamphlet form, as provided by law.
