MC-87-399 AN ORDINANCE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF MCHENRY, MCHENRY COUNTY, ILLINOIS, AS FOLLOWS: SECTION 1. Section 13-1221 of the City of McHenry ordinance regulating traffic and motor vehicles be and the same is hereby amended to read as follows: "Section 13-1_221. Authority to Impound Vehicles. Members of the Police Department of the City of McHenry are hereby authorized to remove any vehicle from any street, highway, alley, municipal parking lot and other- municipal property and to cause said vehicle to be stored at the City Vehicle Pound or authorized garage as determined and designated by the Chief of Police under any of the following circumstances: (1) When any vehicle is left unattended upon any bridge or upon any approach thereto, where such vehicle constitutes an obstruction to traffic. ( 2 ) When a •vehicle is so disabled as to constitute an obstruction to traffic and the person or persons in charge of the vehicle are, by reason of physical injury, incapacitated to such an extent as to be unable to provide for its custody or removal. (3) When any vehicle is left unattended and is so parked illegally as to constitute a possible hazard or obstruction to the normal movement of traffic. (4) When any abandoned vehicle is found on any street, highway, alley, municipal parking lot or other municipal property. (5) When any motor vehicle has been parked on any street, highway, alley, municipal parking lot or other municipal property for a period of 24 consecutive hours. ( 6 ) When any vehicle is parked in violation of Section 13-1.214 ( snow removal) or 13-1219 (fire lanes). ( 7 ) When any vehicle is parked in violation of official signs indicating that parking, standing or stopping is prohibited at all times or during designated hours or prohibited for longer than indicated on such sign. Vehicles so towed away and removed shall be restored to the owner or operator thereof after the payment of the expense incurred by the City in removing and storing such vehicles. SECTION 2. Any person, firm or corporation violating any provision of this ordinance shall be fined not less than Twenty Five Dollars ($25.00) nor more than Five Hundred Dollars ($500.00) for each offense committed on each day during_, or on which, a violation occurs or continues. SECTION 3. All ordinances, or parts thereof, in conflict with the germs and provisions hereof, be and the same are hereby repealed to the extent of such conflict. SECTION 4. This ordinance shall be published in pamphlet form by and under the authority of the corporate authorities of the City of McHenry, Illinois. SECTION 5. This ordinance shall be in full force and effect from and after its passage, approval and publication in pamphlet form, as provided by law. PASSED this 15th day of April , 1987.
