AN ORDINANCE
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
MCHENRY, MCHENRY COUNTY, ILLINOIS, AS FOLLOWS:
SECTION 1. Chapter 7 of the Municipal Code, City of
McHenry, Illinois, be and the same is hereby amended by
adding thereto the following provision as and for Section
7-23 thereof:
"Section 7-23. Sidewalks in Commercial and Office
Districts. No construction permit shall be issued
in connection with any premises zoned Commercial or
Office District unless a sidewalk meeting the
specifications set forth in the City of McHenry
Subdivision Control Ordinance for commercial and
business property is then in existence along the
entire frontage of said premises, or, unless, the
application for such construction permit shall
include, as an integral part thereof, the
construction of such sidewalk at the sole expense of
the applicant or owner of the premises, in
accordancd with the terms and specifications of the
City of McHenry Subdivision Control Ordinance. No
occupancy in connection with such construction
permit shall be allowed until such sidewalk is
properly installed and accepted by the City."
SECTION 2. Any person, firm or corporation
violating any provision of this ordinance shall be fined
not less than Twenty Five Dollars ($25.00) nor more than
Five Hundred Dollars ($500.00) for each offense committed
on each day during, or on which, a violation occurs or
continues.
SECTION 3. All ordinances, or parts thereof, in
conflict with the terms and provisions hereof, be and the
same are hereby repealed to the extent of such conflict.
SECTION 4. This ordinance shall be published in
pamphlet form by and under the authority of the corporate
authorities of the City of McHenry, Illinois.
SECTION 5. This ordinance shall be in full force
and effect from and after its passage, approval and
publication in pamphlet form, as provided by law.
