ORDINANCE NO. MC-86-374
AN ORDINANCE
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
McHENRY, MCHENRY COUNTY, ILLINOIS, AS FOLLOWS:
SECTION 1. Section IC3 of the Subdivision Control
Ordinance be and the same is hereby amended to read as
follows:
"3. After review of the preliminary plat and
negotiations with the subdivider on changes deemed
advisable and the kind and extent of public
improvements which will be required, the Plan
Commission shall recommend approval, approval with
conditions, or rejection of the plat to the Mayor and
City Council for action.
The approval of a preliminary plat by the Mayor and
City Council is tentative only, involving merely the
general acceptability of the proposed subdivision
layout. Such tentative approval shall be considered
permission to the subdivider to submit the final plat
and detailed engineering plans and specifications and
reports for the proposed subdivision and for all
public improvements to be constructed in connection
therewith. If, the Plan Commission or the Mayor and
City Council, determine that the engineering plans,
specifications or reports disclose the requirement of
making changes in the preliminary plat, as tentatively
approved, the subdivider shall revise and resubmit the
preliminary plat for reapproval prior to the approval
of the final plat by the Mayor and City Council."
SECTION 2. Section ID1 of the Subdivision Control
Ordinance be and the same is hereby amended to read as
follows:
" 1 . After the tentative approval of t'he
preliminary plat by the Mayor and City Council and
prior to the filing of an application for approval of
the final plat, the subdivider shall file with the
City Clerk 10 complete sets of engineering plans and
specifications and reports, prepared by and bearing
the seal of a Professional Engineer registered in
Illinois, for the construction of the subdivision and
of the subdivision improvements in conformity with the
requirements of this ordinance."
r SECTION 3. Section VIIIDI of the Subdivision Control
Ordinance be and the same is hereby amdended to read as
follows:
" 1 . After the tentative approval of the
preliminary plat by the Mayor and City Council, and
prior to the filing of an application for the approval
of the final plat, the subdivider shall submit to the
City Clerk 10 complete sets of engineering plans and
specifications and reports, prepared by and bearing
the seal of a Professional Engineer registered in
Illinois, for the construction of the subdivision anid
the construction of the following and all other
subdivision improvements:
a. Streets
b. Curb and gutter
c. Sanitary sewerage system
d. Storm drainage, including sewers
e. Water supply and distribution system
f. Street lights
g. Sidewalks
h. Street signs, guard rails, landscaping, etc:.
i. Public utility locations
j. Such other improvements that may be required
by this ordinance, annexation agreements or
by the City Council as a condition of the
tentative approval of the preliminary plat,.
SECTION 4. Any person, firm or corporation violating
any provision of this ordinance shall be fined not less
than Twenty Five Dollars ($25.00) nor more than Five
Hundred Dollars ($500.00) for each offense committed on
each day during, or on which, a violation occurs or
continues.
